Pretty much, no one outside a Crime lord (or other real criminals they can’t get other charges to stick) goes to jail in that case. You fess up, agree to pay, and no jail time- other than what you already spent.

More or less, you’re not in any real danger of going to jail, since you had no tax liability. You will lose any refund after 2-3 years. But the IRS might be *damned *nasty for a while, so you should find a Tax Pro and get that done. Failure to do so could be very very bad, even if you don’t get convicted of a actual crime.

Yes, true. But you do not want to be in the position of trying to prove you didn’t owe. DO worry about it. Don’t worry about going to prison over it, true.

Here’s what will happen:

The IRS will send you a series of letters asking you to file. Then, if no reply- they will propose filing for you, not allowing ANY DEDUCTIONS AT ALL. If no reply they will send you a “90 Day Notice” , and if you do not reply by 90 days they will assess that plus a shitload of penalties, including Failure to File and maybe even Civil Fraud. The IRS can then put a lien on your income, a levy on your bank account, and sieze anything you may own that they can sell for a decent amount. True, the chance for jail time is tiny. But it will ruin you financially.

So, call a Tax Pro now, get those returns filed.

You have to realize that I am 43, and I’ve filed perhaps 15 years out of the last 27 that I have been working and paying taxes. I’ve even owed, and it was taken out of the next time I filed a return where I got a refund. Also understand that I’ve never made much money, and they probably really don’t care, but still…there is no way to go back and file those taxes. I don’t even have a clue which years they were, except that I didn’t owe; I’m sure I would have heard about that. I just went the longest time seriously believing you only had to file if you owed. Hell, I’ve had the State hold my state check for YEARS, finally posting it in the paper along with all the other lost revenues. While I don’t expect the Feds to do that <or the state either>, I am now truly surprised they haven’t ever audited me. I’d be screwed. I keep no records at all.

Good on the courts for sending a message to deadbeats. Snipes will of course come out of there with some undeserved rep for having been in prison, and his movies will make even more money.
