I wonder if the survivor is a victim, or a suspect.

According to the article it was the person who rescued the survivor who called it in, not the survivor him/herself. So at this stage he/she could still be either.
Note the information about 39 on the boat, etc. This could only have come from the person rescued. If the person rescued were a human smuggler he would probably simply have said “I was out here by myself and the boat overturned in the bad weather”. But perhaps you are right and he has a conscience.
