It’s very common for people to waive extradition, which happens a lot when someone is already in custody in state A, and state B wants them.

I did make a mistake in my post, though. I think there is discretion in the part about a fugitive who was outside of the state when the crime was committed, but I was wrong about there being discretion in other ways. I think DeSantis could perhaps cause delay, but under current case law, he can’t just refuse if NY has proven that Trump is required to be extradited under the interstate agreement.

Interesting what DeSantis did here though. It was already in the news that Trump was turning himself in on Tuesday. So, that’s the strategy the Trump team decided on, which is a quite sane choice.

Then, DeSantis says he won’t cooperate with extradition. So, he potentially gets a few points for refusing to cooperate in the “witch hunt,” and he potentially baits Trump into making a much less sane choice of strategy, and maybe also manages to make Trump look weak for turning himself in.

I agree with the prosecutor, but I’m not sure about the defender. For the most part, being part of Tumps legal team has not been a good thing for ones career.

And they don’t respect all of that part!

Just so I’m clear, extradition only comes into play if the person is already in custody in another state, or being at liberty in another state refuses to surrender to either state, right? If Trump voluntarily turns himself in to the NY DA, that eliminates any question of extradition, and there’s nothing DeSantis can do about it, right?

Then what was the point of sealing the indictment?

Well, trump doesn’t know the charges until he shows up.

Has Trump been informed of the charges on the indictment? Or will he find out when he arrives?

I gather that’s just their process in this venue. Not all indictments are sealed in all venues. Hell, where I worked, we rarely used grand juries. There are other processes to get where they are now.

In this case, I think sealing is a good idea. Manhattan has little ability to control Trump’s behavior until he goes before a judge. If Trump knew the charges ahead of time, he has a unique opportunity – one available to few (any?) others – to attack the DA for the specific charges being brought and argue his case in the press. As things stand, Trump can lash out in general terms, but not about anything specific. It’s bad enough without giving him additional ammunition.

He will do that as soon as he’s charged, though. Honestly, I think it’s unlikely it will make any difference.

there are cases where the whole process is secret, because they are worried the accused might run, or murder a witness, or whatever, before they can be apprehended. But this doesn’t appear to be that sort of case.

Not if he is instructed by a judge not to. Or if he does, he’ll be summoned back to the court for a formal gag order or if one is imposed at the arraignment, a more strict gag order. If he continually disregards the gag order, he can be remanded to custody so they can better control his mouth. Unlikely in this case, but an available option. Prosecutors have a right to an untainted jury pool as much as the defendant.

Trump is a high profile defendant, so people are learning more than they ever wanted to know about their criminal justice system. But this is not uncommon. Remember Roger Stone defied Judge Amy Berman Jackson’s instructions to leave off with the provocative memes, one of which was a gun target imposed on a picture of her head. His gag order became quite restrictive as a result.

I don’t know what sort of cases those would be, so I can’t help there. You’re right that this isn’t that sort of case.

To say nothing about declaring the 14th amendment was unconstitutional and a President has a Get out of Jail Free card now and forever.

If he doesn’t, do you suppose one of those “You’ve won a major award. Come on in and collect it,” stings would work?

Telling him he’s won the Nobel Peace Prize would definitely do it.
