The photo was taken by an activist group.

My guess was that they just used a small drone with a camera to get high enough to look over the tarp and onto the wall. Probably legal, unless that part of Washington is a no-drone zone for some reason.

Seems like a good guess. The pics appear to be taken from mid-air, and have the wide-angle look of a GoPro lens.

Drones of any size are still subject to FAA no fly zones. And pretty much all of DC is a no fly zone, unless given explicit FAA authorization.

Not the easiest thing to enforce, of course.
