Disagree. Regardless of their ability to execute, they met the requirements under the UCMJ to be charged with Article 94: Sedition. And they should be. If found guilty, they should be executed. Part of what makes them noteworthy, is that they’re also alleged to have murdered two people who knew of their plot and tried to back out. That’s strong circumstantial evidence both that the plot existed in a more sophisticated form, and that they were serious about following through with the attempt.

The way I read this BBC article, I think the double homicide caught the cops’ attention, who then questioned the known associates of the decedents. I bet someone’s story didn’t add up, and the police kept up the pressure until one of the conspirators flipped.
I would like to weigh in on the side that is against people forming militias to assassinate the president. Ok, flame on!

So, how does a group, who intended to capture a military base and usurp the U.S. Government, allow themselves to be arrested?
Frankly, my first thought was : surely that’s an FBI infiltration operation amongst idiots that went very wrong or something like that. Four guys stupid enough to think they can overthrow the US government all by themselves can’t have conceived a plan to do so. So I was picturing something like :
Private : Why do I want to kill the president and overthrow the government, already?
Infiltrated FBI Agent : Hands documents stating that Obama is a foreign Muslim and that the government should get back to the people

I don’t think they should be executed. However, for an appropriate comparison, imagine if you will, that we were in 2007 and there were three public sector union employees and the head of the local chapter of the union, devising a plan to assassinate George Bush.
