Ways to drive out an Illegal Auto Club downstairs?

Last month or so a “fire extinguisher” company moved downstairs below our loft/apartment. The “spokesperson/pr guy” made an effort to shake our hands and tell us that it would also double as a meeting/club house for their auto club. He went on and on about wanting to be “a part of the community” and not be seen as just motorcycle guys “causing trouble”.

I didn’t care one way or the other, but thought it odd that the (rather impressively constructed) store front, didn’t look like a store. Though it DID have an awning that said it was a fire extinguisher business. It also had French doors, and a LOT of seating…. He said they would keep the whole sale extinguishers in the back. Well soon before they even “opened”, they started throwing parties. Every weekend it would be “something special or else they wouldn’t throw it”.

At this point it has become quite apparent that the extinguisher business is just a front and that it’s actually a lounge party house for their auto club. It wouldn’t bother me, but they are SOOO f*cking disrespectful. The bass in their speakers literally shake our walls, and our apartment is not even directly above them!

The other day, I walked outside after peaking in to my neighbor’s – who does live directly above them- Jewish Passover thingy; and there sat 3 motorcycles right in front of my door! Like I literraly had to crawl over them to get out! My neighbor said that if he wasn’t “so pissed” he would say something. To HIS credit he has been talking to them…just too leniently in my opinion. I decided to take it to the streets…as they say. I barged into their meeting, (before I even said anything they said "the bikes”). I told them that “their bikes were right in front of our door. We cant get out of the house, and it was crazy disrespectful with all of the literal space on the street. Why would you do that?” They offered no explanation, but sheepishly went outside and apologized for the “violation”. In sum, I let them know that, despite the neighborhood, I’m a black person and will throw shade on their $hit in a second.

You see my neighbors and loft mates are well meaning liberal minded persons of non minority status. So, while they may not be intimidated perse’ by an all Latino/Black motorcycle gang…they did say that they didn’t think it was “right to call the NYPD on people, especially men, of color ”……I do appreciate their sentiment…but…

I told them that I was a person of color and I have no prob calling the cops on those clown in a second.

But there’s a hitch. Apparently, OUR apartments are commercial spaces. The general thought amongst the roomies is that technically the landlord wasn’t suppose to turn our upper floors into apartments, so we can’t really call the cops on them because no one is “supposed” to be living there. Despite the fact that they have an illegal bar, lounge, and violate city noise limits – they believe we have no options.

I’m at a loss for what to do that doesn’t involve me getting stabbed one night while mouthing off to a motorcycle gang.

If anyone knows anything about law – or can just offer sound REALISTIC mediation advice - it would be much appreciated.

Are you absolutely sure the club is illegal? I mean, are they selling liquor without a license? Are there fire code violations, or is it just a bunch of club members meeting up a the “fire extinguisher” business to hang out?

Living in an illegal apartment is going to be trouble for you. You can’t get the authorities deeply involved without them finding out that your landlord has violated the law and you can lose your home.

You may just need to go through your landlord, he has a desire to keep you guys in the apartments, maybe he can help force these guys to cut back on the noise, so you can both exist illegally, and pay him money.

If the building is commercial, they might be there legally. And you may well be there illegally. Seems to me if you call the cops or contact the authorities, you may be moving out.

However if they are serving alcohol and aren’t licensed, then you might be able to get authorities involved.

  1. Contact your landlord and see what they can do about it. Seems that there’s a lot of assuming going on. Facts are better to work with.

  2. Contact a lawyer and see what can be done discretely.

  3. Move. This might be your best option.

  4. Live and let live. Get use to it. Join the club.

Hmmm. Yes. they have a flat screen tv, chairs, leather sofas, pool tables, a huge bar area, and not one fire extinguisher in sight. They also keep the windows covered in the day time and are never open to actually sale these alleged fire extinguishers. If they actually had to rent the space as a “club” there would be so many more hoops to go through. So, I’m pretty sure they just put up a front as a store that’s never open.

Unfoturnately I believe we are also illegal tenants. Maybe an anonymous tip?

yeah…in repeated negotiations with them they typically agree to meet the us half way and that doesnt pan out come the following week.

But they do always say we can come party with them…sooo…sigh, rubs brain

You need to get yourself some evangical Christians, a Salvation Army band maybe?

I’d be looking to find a friend who has a brother or cousin or boyfriend that’s a cop. See if you can get him and his buddies to stop by a few times. They won’t want to be there if cops are always coming by to see you!

Burn the place to the ground.

Definitely call it in (anonymously) the next time they park their motorcycles on the sidewalk. That’s against the law whether you’re there legally or not.

The only “auto club” I know of is AAA, and yours apparently consists of motorcycles which makes it all the more perplexing.

Motorcycle club whose clubhouse appears to be a front? Could be 1-percenters.

If it is a group of 1%s, another 1% group just might do that.

are they selling alcohol? If they’re not, this is just a small business owner inviting friends to his shop to hang out. Annoying, yes. Illegal, no.

Consider this a good lesson in why cities have zoning laws, and start looking for another place to stay. If you live in an industrial zone, you can’t expect a nice quiet residential life.

Contact a rival biker gang and say they’re moving in on their turf. Buy bulletproof everything for a couple months or so.

Or more sensibly, find out if you’ve been renting an illegal apartment. If so, talk to your landlord and tell them that you’ll be moving out and demanding all of the past rent that you paid on an apartment that’s illegal.

alcoholic beverage control would be your best bet. as I learned here, there are games that can be legally played. (a private party held at what is normally a business does not an illegal bar make)

another thought, depending on the zoning type, their party may be exceeding legal occupancy. fire inspectors will cite them faster than you can say “great white”

other people you want to talk to is the IRS they are doing this as an excuse to treat the club facilities as a business xpense granted there are ways to make it totally legit and the IRS could care less. somehow I doubt this is taking place.

Why don’t you join the club?

If the motorcycles are all lined up in a row, push them over like dominoes. Motorcycle guys get a laugh out of that.

Instead of speculating and doing the “what if” thing, how about doing some fact finding first and then making a plan?

HPD can tell you if there has been a multiple dwelling registration filed for your building as long as there are at least 3 residential units.

If your building was built after 1929, it will have a C.O. on file at the Dept. of Buildings. The C.O. will specify the use of the building.

NYC DOB also has a Loft Board (280 B’way) that oversees the legalization of IMD’s. You may want to call them for guidance.

Seriously? I agree with JerrySTL’s list: Complain to your landlord (don’t threaten, just tell him how annoying the noise, etc. is); find out the legal situation with your apt. and what your options are; consider moving. I’m sure there are resources for renters in NYC, including possibly free/cheap legal advice.

Less seriously? Set up speakers pointed at the street/entry to the store. Crank Muzak/Conway Twitty/Show Tunes or whatever is calculated to make the atmosphere undesirable for the bikers without actually being offensive. I understand it works to keep undesirables from hanging out around 7-11’s and the like.

Complain to the landlord and then expect nothing to be done. Call the police and then expect nothing to be done. Complain to the bikers and then expect nothing to be done. In NYC my experience has been that the NYPD is amazingly awesome for all things violent crime related and amazingly terrible for all non-violent crime issues. If they aren’t assaulting people or anything the NYPD is not going to care at all what they do with their time or how much it bothers you. I’ve made more than 30 calls in the last several months regarding my jackass neighbors and their constant pot smoking in public areas of the building and they could not care less.

However, I’m looking to move to another state soon, so if you are cool with pot smokers I can recommend a soon-to-be vacant 2 bedroom with zero motorcycle problems. :stuck_out_tongue:
