No, it is not. It is exactly what Madison did to Marbury and SCOTUS agreed. More precisely, they said it was wrong but there was no remedy for it. The court could not order the document (a court appointment) to be delivered.

But that was because the Supreme Court could not be given mandamus jurisdiction.

The Court held that the mandamus clause in the Judiciary Act was unconstitutional and it had no power to direct the commission be given to Marbury.

It did say, in obiter, that the refusal to deliver the commission was likely illegal.

That seems to me to leave open the possibility that if the District Court has mandamus now, that an order to deliver a commission may be available. I don’t know if that issue has come up since Marbury as a matter of district court jurisdiction.

Trump can order military action any time between now and when his term expires. Whether the military deems such orders to be illegal and unlawful remains to be seen. I don’t see military action against Iran as overthrowing the Constitution. I see it as Trump fulfilling a goal to prevent Iran from attaining nuclear weapons capability. That he would do this at the end of his term and create fucking chaos for the Biden administration is merely coincidence.

At this point in time, with two weeks left before the new C in C takes over, if the donald ordered an attack on Iran with no intelligence to back it up (pun intended!), I would expect to see the slowest military response in history (“We’ve lost the keys to the Pentagon. We’ve go a locksmith on the way!”, “All the bombers are in the shop! We only have loaners.”, etc.)

It’s been noted in two other threads already that Iran has issued an international arrest warrant for Trump. Interpol will not honor such a warrant against a head of state (or certain other high officials), which is why they ignored the earlier warrant for Trump. And the United States would not render Trump up to Iran even after he leaves office. But Scotland might, if the former president just happens to be there at 12:01 p.m. on 20 January.
