Where was Scalia?

When the Pledge case was argued 3/24, where was Scalia? He had recused himself, so did he leave the courtroom?

I cannot speak to the US Supreme Court, but I can speak to recused justices on another court. For oral argument, they either hang out in the cloak room or go back upstairs to the office. When the case is up in conference, they leave the room and hang out in the hall for a few minutes or head back to the office.

Are you serious? That is hysterical. I have this image of Scalia pacing nervously, then looking to corner Thomas in the mens’ room at his first chance:

“Well? Well? What’d they say, huh?”
"Now Tony, you know I can’t … "

The non-lawyer actually got Scalia to recuse himself. Not bad for an amateur.

He was in an entirely different duck blind than the rest of the court.

Although Newdow, the petitioner, was representing himself, he is in fact a lawyer, Measure.
