So, would Perry have a legal cause for action against Fox News? By the standards they agreed to, he should have been in the main debate, until they changed the rules so he wouldn’t be. Could he sue them over that?

IANAL but doubtful. AFAIK they never announced the specific polls they would use or a specific methodology for combining/averaging them.
They did say the five most recent then threw out the fifth and went back to the sixth.
The claim is that there was tie for the last spot.
What they should have done was just add the sixth poll results to the other five as a tie breaker.
In the end it really didn’t matter. Fiorina was the clear winner despite being at the kiddie table. The kiddie table debate was one of the most watched debates ever. Perry had every opportunity to make his case and just failed.
