I hate to say it, but I have been around this block a few times myself, and when the OP reads like this one, there is usually quite a bit of relevant information that has been left out by the poster.
YMMV, of course…
And Tony, since drunk in public is a violation of the law, they can use an acceptable testing method to verify your level of intoxication- breath, blood & urine (rare). IIRC, if you want the least accurate reading of the three, stick with the breath test and don’t let them near your bodily fluids (breath is the most prone to false positives and inaccurate reads, but blood is damn near impossible to beat).
I never said I don’t like cops. Just that we are over policed and that they have too much authority, which btw they use often to “punish” those they feel are guilty instead of letting the Justice system do that. Abuse of power is no laughing matter, and it is a fact that it happens often.
When I read the thread about the person afraid to not contribute to the phone solicitor who claimed to be representing a law enforcement agency because he/she was afraid they may come bust down his door I just shook my head. That is not the kind of fear that should be instilled in citizens by law enforcement. Granted, it is an unfounded fear, but it is one many people have. And I think that is sad.
The lesson would be: He was drunk and shouldn’t have been in public in that state. Call a cab. They were within the law to arrest him. Trying to sue for harrassment would be a waste of time. He would do better to sue for harrassment on those other occasions he mentioned wherein he wasn’t committing a crime. Your assement of me is disturbing to say the least. But you’re opinion is your right. And defending my family and property are mine. If someone breaks into my house, if I’m not there to save them from the dog, then they may not live. If i’m there, I may not kill them, but they will be injured severly. Protecting the life of my family and property is something I take seriously.
Monty: Point taken and I agree wholeheartedly. I rescind that comment.
SandyHook: Thank you for the welcome. I’ve read this board for a few years and have learned a lot here. If Cecil is the smartest man in the world then I would only add to that that the SDMB is the smartest MB in the world.
Oddly enough (or perhaps not so much so), no further responses from Biohazard.
Actually the op stated he requested it. And that is within his right to do. For someone who’s uncle is a world class lawyer though, he isn’t exactly the brightest light bulb in the socket. Any lawyer will tell you to refuse to take one. It only serves to further the case by supplying them evidence. Requesting one will get you a huge :smack: from a lawyer. (unless of course you know for sure you haven’t been drinking)
I got picked up for P.I., hadn’t even been drinking (aside from a couple of beers app. 9 hours earlier), demanded a breathalyzer, and was told they don’t have to give one for public intoxication. Spent the night fuming in jail.
Long-haired guy walking at night in a smallish Southern town, it happens.
I know what he posted, neuroman. I am not illiterate & what he posted is right there at the top of the page. It is very unlikely that the police just decided to pick up some random individual and charge him with public intoxication. Also, in case this has escaped your notice, sidewalks along roads are, well, they’re along roads. The police have a duty to remove someone from a dangerous situation when they observe them in said situation.
I don’t believe the police harass the OP “every time [he goes] for a walk.” I don’t believe the police arrest the OP “every time [he goes] for a walk.” I am fully aware that walking in the street in dark clothing at night in an inebriated state isn’t exactly safe.
In short, I call “horse manure” on the version of events related by the OP.
You may disagree. Fine, disagree. But don’t expect me to buy it absent actual evidence. The police seem to have been a legitmate target for prejudice and abuse on these boards for quite some time. & it’s wrong.

There may well be more to this story but if this is just about a guy arrested walking home after three drinks, thank Christ I don’t live in the small town where this happened. The Irish cops wouldn’t do anything else if they had to enforce the law in this manner.
I suppose a reflector belt wouldn’t work too well with the Goth image;).
Slight nitpick here, another reason that guys can drink more alchohol is because they have more of a certain enzyme that breaks down alchohl in their stomachs then females. I forgot what its called but Zantac (maybe?) the Acid Reflux medicine lowers the amount of this enzyme.
Anyway, to answer some of the questions, I am male, around 155 pounds, and I didn’t have anything to eat all day other than 1 bowl of cereal for breakfast.
My OP says what happened, I haven’t left anything relavent out (I think).
This happened and is not BS.
As for the 2 handcuff keys, it was a safety measure incase I lost one at a critical time.
Let me add one more thing, I talked to a friend of mine that’s in the police force, he knows the 2 guys that arrested me and he said hes heard that they go overboard alot.
Years ago I accepted the fact that some people are more likely to be targeted by the police because of the way they look. First it was because my boyfriend at the time, a “rocker,” regularly got stopped by police when he was walking through a posh neighbourhood (to our friend’s house). Then it was because most of the black people I knew said they were at times treated “differently” by the cops. (DWB, anyone?)
I personally have never been harassed by the cops and I have done as many illegal things as people I know who have repeatedly been arrested. I believe my conservative appearance has a great deal to do with this.
Now, this doesn’t mean that you have to believe everyone who claims that this has happened to them. But crikey, people, he was DRUNK IN PUBLIC! Do you really, honestly, truly believe this merits a night in jail? What kind of a world do we live in where it’s okay to condemn people to prison because they were walking home from the pub? How many of us have not done the same? Fuck. You don’t have to believe him that he was targeted because of they way he was dressed to be able to give him some empathy about being treated a bit harshly.
I personally would rather the cops around here, whose salaries I pay and who are supposed to be protecting me, find something to protect me from other than tipsy Goths walking home at night.
You know, when a cop stops me to ask a question, I generally am very polite. I tend to call him/her ‘officer’ and not ‘fucktard’. Maybe its because I don’t think I’d appreciate being called that after a hard day at my job. Its a respect thing. And you know what? Darned if they don’t appreciate it.
Ask your self a question: when you’re at work, doing what ever you do, who do you cut slack? Someone who pays you some respect? Or someone who curses you out? You see, there are two menus (like in France). One is for normal people and the other is for Assholes. If you want to dish out Asshole lip, then you better be prepared to pay Asshole prices…
