I was completly curteous, at least until after I had the ticket and was in the tank. Then I got a little mad.
But still, My OP was also the result of restraining myself during the whole incident.
And by the way, I was sober.
Typical cop bullshit. Some of them not only think its ok to treat you badly, but think its pretty funny to boot. Its a shame that our legal system allows this kind of thing to go on, I don’t think you have a prayer in court because all they have to do is lie about your behavior, they win by default. In a perfect world the cops would spend the night in jail after doing nothing to deserve it. Then it should happen at random, whenever you get the urge…just be sure to laugh at them jokingly.
Well, here is my guess at to what “Really happened” tm.
Our Op was slightly drunk. Being a good citizen, he decided to walk home. So far, so good. The Police thought he looked out of place- maybe that black trechcoat or something. Ok- not so good on their part, but hey. Then they started asking BioHazard a few routine questions. He started getting upset, maybe even calling them “fucking nazis”- something all our “boys in blue” love to hear. :rolleyes: So, even though they rarely arrest dudes for walking drunk, they arrested him for 'contempt of cop"- the drunk part was the legal excuse- and it was legal. I am sorry, but after this rant, and your attitude- I am not going to believe you were “completely curteous”.
I’ll bet a nickle if Biohazard had simply told the officers politely that he was just trying to not be a drunk driver- they would have either let him go, or even drove him the rest of the way.
So was it right of them to arrest Biohazard for basicly being rude to them? No, not really- but DUDE- when you aren’t 100% in the right- never make the Police WANT to arrest you. You’ll lose. You lost this time. Even if you are 100% right- think twice.
I mouthed off to two LAPD cops. They planted drugs on me. The DA must have figured it out- he wouldn’t even bring charges (he even worded it as “refused to bring charges”). But still, it wasn’t fun. I had a GREAT lawyer that said we could sue & win- then I’d have to move out of town. 
Bricker- we both know a lot of things are illegal that aren’t usually enforced. If he hadn’t have been rude- if he had been polite & cooperative- he wouldn’t have been arrested. But what he did WAS illegal, so being rude made it the only crime there is no appeal from- being stupid.
Sorry, Bio- I have my sympathies for you on this, but there it is. You were stupid.

FWIW 0.08 isn’t even close to sober.
Here in Wisconsin, it is legal to operate a vehicle at .1. That must be considered sober enough to drive. I would think .08 would be more than sober enough to walk for cripes-sake.

The Breathalizer test was about two hours after he was picked up for Drunk in Public. He could well have been over 0.1 at the time.

Man y’all don’t know shit…my hometown has an open container and PI law that allows your arrest in your fucking FRONT YARD…You can be sitting on your front porch and because you are visible from the street (provided you are) You can be ticketed and possibly arrested for open container and/or public intoxication.
Now smoke on that for awhile…been there and done that already

It’s not far from it. But the fact is, it was at least 2+ hours before he blew that. The typical answer (as any officer will tell you) to the question “How much have you had to drink?” is 2-3 drinks. :rolleyes:
I happen to be a larger person (260lbs.)so 3 drinks for me might produce .04 (probably just an ignorant guesstimate). I don’t consider that drunk. Even so, I can feel it after just 1 beer. After 3, I would tell you I feel no effect. Kind of odd I suupose, but still it’s true. I can’t explain the science behind it. But I still will admit even that can affect my mental capacity. When I used to drink I drove many times WELL beyond that. Probably more like .15… Well ok, maybe .2-.3. That’s pretty fucking drunk. I woke up many times wondering how I made it home. I shouldn’t have been in jail, I should have been buried underneath it. A couple of times I woke up and asked “who’s car is that?” The answer was always “I don’t know but you came home in it. Where is your car?” I don’t drink anymore.
Thank God I’ve never had a dui. I deserve to be cited for several. I’m either a very good driver or a very lucky person. (I opt for a combination of the 2).
I have had my share of pi’s when i was younger and loved to get into barroom brawls. There was no question as to my being intoxicated. But I didn’t want to sue the cops for running me in. I fucked up. Period. End of story.
I can jump on the “fuck the cops” bus faster then most of you. But not in this case. Bio, says he wasn’t drunk. Yeah, and everyone in prison is innocent too. I only met 1 that was. (another story).
Hey man, you don’t want the cops to fuck with you, then stay away from them and where they hang. Walking down the road slightly drunk isn’t that place. If you were so close to home BEFORE you left the bar (which you indicate) and you KNOW they already have a boner for you the size of Florida, then WTF?? Why are you walking down the street (which btw sounds like a rural street with no sidewalk)??? No friends in the bar that aren’t drunk? No cabs? What?

I have no reason to doubt the OP’s story and neither does anyone else as far as I know. If we accept that the OP’s version of events is true, surely there can be no debate on the rights and wrongs of the treatment he received. He had three drinks and walked home, for fuck’s sake. How, in anyone’s moral code, does that justify a night in jail.
It’s OK to criticise the cops once in a while. They do make mistakes and civil society won’t implode if that’s acknowledged.
Think about it folks, if you down a shot or two and leave the bar right away, only to be stopped on your way home, your blood alcohol content is going to be going UP for the next hour or so as it’s absorbed. Booze isn’t crack, it takes a while to kick in.
Right about the time you were expecting to be home in bed, THAT’S when one get’s tested by the police. And that’s how walking home with a 0.03 turns into a 0.08 in jail.
Around here, if the officer states that you smelled of alcohol and/or were acting intoxicated, you’re toast as far as beating the P.I., no matter what your BAC might have been.
Yes, it sucks. It’s okay to be drunk in a bar, but not while you might be walking (or waiting for a ride) home outside said bar.

A night in the drunk tank. For being drunk. An we have only BioHazard’s description that we wasn’t even tipsy and that hours later was tested and found to be legally intoxicated. Hours later. And that the other drunks were hitting on him. I guess it’s possible that the only other drunks arrested that night were homosexual. I think it’s more likely that he was trying his best to relate a wannabe prison-rape scene not fully realizing that heterosexual prisoners don’t often do the prison-rape thing if they are only locked up overnight.
I’m sorry. Only one hour. Long enough for his liver to metabolize an ounce of alcohal. And still test as legally intoxicated.

It may just be teh fact that I have a BAD case of the flu right now (which was probably the main reason I was so “tipsy” that night), or it may be the fact that I’ve had about 10 hours of sleep since friday, but is it just me or are the majority of the people here ripping on me massivly?

Bitching about having your handcuffs and two handcuff keys taken away after you were detained is a waste of bandwith as well. OF COURSE they are going to take them away.
You seem to have a chip on your shoulder which also tends to alienate you from posters, where they might look a bit further than face value at your words.
Drumming up the good old “MY so and so is…” comments might also come across as elitist and rub other posters the wrong way.
