No, that is Constitutionally incorrect!
Yes, in between demands for three bowie knives and five minutes with Ariel…
It may be ‘Constitutionally incorrect’, but I guarantee you that it is not something that you want to try and prove me wrong on. I have ‘been there, done that, got the t-shirt to prove it’! Just because it’s ‘Constitutionally incorrect’, DAMN sure does not mean, that it does not happen, EVERY DAY!
If you were arrested in violation of the 4th AM, consult a lawyer.
I went by the park opposite the Justice Center in Cleveland today and counted eight news vans with satellite dishes. This case is getting a lot of attention.
That would be a pretty classic example of an unduly suggestive identification technique. You can’t just show people pictures of one person and ask if “that’s the guy who did it.” Victims will generally answer yes (for reasons that would fill up an entire thread), regardless of whether or not it’s true. Any subsequent in-court identification of the suspect by the same witness would be barred.
That’s true. The cops could have simply asked the women if they interacted with anyone else in that house besides the accused. If they said No then that eliminates the brothers from direct involvement.
I said “interacted with” because some people might have provided support. Bringing food, supplies or even medicine. Somehow that new born thrived and grew up to a healthy six year old.
I heard early reports that the three brothers were together when the police actually found Ariel. Given the nature of the case and the men’s relationship to one another, it seemed logical at the time.
I agree, if someone’s name and picture is splashed all over the news as “arrested in suspicion regarding 10 year kidnap-torture-rape case” maybe someone should be explaining why they got such publicity with basically zero evidence. Someone in the system screwed up This is a LOT worse that a bunch of facebook users “outing” the wrong bombing suspects. Weaseling out with “but we didn’t actually say they were guilty” is a bit of a cop-out.
I suppose the only saving grace is that the public exoneration is getting almost as much press.
This is what I came in to say. And I’m pretty sure that when I heard it, it was coming straight from a LEO’s mouth.
You really think it would be done in a way that was actually illegal? “He was free to go the whole time, I swear” or “He was charged with disorderly conduct” or some other stupid charge that doesn’t really have any requirements.
Who is the judge going to believe, the miscreant or the guy he plays golf with every Sunday?
And that’s not even counting the fact that it was obviously a long time ago. Flippant remarks like yours are not helpful in the slightest.
LEO?
If they were all together when Ariel was captured and the two brothers were allowed to walk, the public would go insane. As it stands now, despite their release, it’s difficult to believe that they knew nothing of their brother’s crimes. Yes, it’s possible and I accept that they are innocents wrongly arrested, just sayin’…10 years!?
LEO = Law enforcement officer.
The suspect’s daughter was best friends with Gina DeJesus. His son did a college news report on the kidnappings a few years ago. The whole family has connections to the case.

Sorry. Law Enforcement Officer - I’m pretty sure the early account I heard of the three brothers being together when they were arrested came directly from someone representing the local police.
Ah, LEO, of course…Duh! lol
Thanks, guys. ![]()
Saying to someone if they think they were arrested in violation of the 4th AM, consult an attorney, is flippant in your eyes, get real!
Word on the street has been that the two brothers are both severe alcoholics and unable to work. Wonder if the stress of knowing their brother’s secret contributed to that?
What an incredibly irresponsible speculation.
It’s more likely that inheriting some money from their father allowed them to become alcoholics and live without the need for regular work.
