By the way, if anyone else is interested, the discussion of sanity appears at Section 6 of the decision. As I read it, the court’s ruling is that psychosis as excuse under Norwegian law turns on whether the defendant is generally disassociated from reality. Finding that Breivik did not fit even this relatively liberal criterion (by American and UK standards), the court held him criminally culpable.

Darn, I just lost my bet. Oh well.

Being prison, the act of punishment is executed by depriving him of freedom. Whether his freedom is limited to one or three cells is insignificant, he is spending the rest of his very life in a confined space. Norway was also under scrutiny a few years back for excessive use of isolation, in Breiviks case. Which may be considered a form of torture (at least that’s what he himself claimed during his first couple of years in prison when he tried to pull a lot of publicity stunts).

Hi Galgrip8r, welcome to the Straight Dope. If you look at the top of the previous posts in this thread you will see that it was last active seven years ago. We generally try not to revive old threads unless there is substantial new information, and a discussion like this one should just be started from scratch as people will “accidentally” try to engage with someone’s discussion points from seven years ago and that poster might not even be around here anymore.

The poster you replied to has in fact not posted for two and half years, so it’s kind of meaningless to engage with him to make points that generally have already been made.
