…and yet Giuliani isn’t Trump. He doesn’t carry the same weight or potential back lash. He’s just a big giant loser without a following.
Will Trump pardon Giuliani ? If the worst happens from his pov, the option of commutation and/or pardon is there. So I guess he is breathing easy these days.
This is a civil matter. I think it’s unclear if presidential pardon power extends to civil contempt, because it’s not an « Offence against the United States » in the classic criminal law sense.
Whether or not it can wipe out civil contempt, presidential pardon power does not extend to lifting the defamation judgement against Giuliani, correct?
That’s my understanding, but IANAUSL.
Rudy ordered to appear at a hearing in early January to show cause why he should not be held in contempt.
And this is bad because…?
Seriously, the “The people whose lives I destroyed are trying to destroy my life by holding me accountable” argument is just sad.
Judge may unseal the portions of Rudy’s former lawyers’ explanation for why they needed to withdraw.
Rudy has said in his filing that he followed their advice and that’s why certain documents haven’t been turned over.
Usually, when a former client specifically relies on former counsel’s advice in this way, it gives a limited waiver of solicitor-client privilege, to allow the court and other parties to assess the argument.
I think you misspelled ‘infuriating.’
I could also have gone with “morally repugnant” but that applies to pretty much everything Rudy does these days.
See, they are just the little people, whose lives are insignificant. Little people experience setbacks in life all the time. But, Rudy is an important guy, whom other people listen to, so destroying his life would have greater impact and must be prevented from happening.
Maybe Rudy won’t be flat-ass broke for much longer:
Does anyone else look at a picture of Rudy and think “This guy is undead!”? Or maybe a Nazi war criminal. I just get a creepy vibe from the way he looks.
I guess he will be first in line for a Trump pardon.
He’s not charged with any federal offences, so no.
Not only that, what he is on the hook for is a civil judgement. Only a judge could vacate that, and it looks like Rudy’s avenues of appeal are all but exhausted.
Judge has unsealed the info from Rudy’s former lawyers, where they explain why they had to quit: they say Rudy was refusing to participate in disclosure in relation to his assets, particularly in Florida.
And Rudy is now advancing his defence to the contempt allegations, saying that the plaintiffs hadn’t filed a necessary sworn document, so the receivership had not yet formally begun, so the court’s orders have no effect, so he’s not in contempt for failing to obey those orders.
Ta-Dah! No contempt! (Says Rudy)
It seems to me that Rudy is either being deliberately obtuse or he’s really really stupid.
Lawyers, correct me if I’m wrong but……
While the two women Rudy defamed will ultimately RECEIVE the property, that does not confer receivership on them or make them “receivers” in the legal sense. As I read it, the receiver is the neutral third party appointed by the court to handle the transfer of the property to its now legal rightful owners and even the law Rudy cites refers to TEMPORARY receivership.
No idea if that’s correct or not. Once a claim starts getting into the weeds of New York debt collection law like this, that’s what New York lawyers are for.
It could very well be the latter, especially if he’s going down the alcoholism and/or dementia path) but I think there’s a case to be made that he’s 80 years old and is trying to keep kicking the can down the road long enough that they can collect from his estate after he’s gone. I think it’s the exact same thing Trump was doing. If he wasn’t elected he’d still be finding ways to delay the trials until his death. Of course if he wasn’t elected he may be in a similar situation as Rudy, having a hard time finding lawyers willing to work with him.
