What the heck is that? I thought Aggravated Crime usually means that a gun was involved? What is “Especially Aggravated”?

And do they have Non-Felonious First Degree Murder in Tennessee?

The second quote is from the Tenn law. I got the impression from the TBI and FBI news conference that Holly was killed when she was being kidnapped. Maybe she tried running away?

Anyway, killing someone while kidnapping them is a special circumstance under the law.

That would explain why sexual assault wasn’t charged. I guess in a way its better that she died before this POS had a chance to rape her and then kill her.

The TBI has been very careful not to release much information. This is just my impression based upon the charges.

Is it even possible to do 1 & 2 without 3? Can one unknowingly remove or confine another person unlawfully so as to interfere with their liberty and cause them grievous bodily harm?

Or what happens if you knowingly confine someone lawfully? Is that possible? Is that only aggravated kidnapping if you happen to break their leg but it was legal to confine them?

I don’t know. I don’t have any real complaint with with idea that harming someone while deliberately kidnapping them is a crime but if every kidnapping in Tennessee is “especially aggravated” - what’s the point? Does anyone ever get charged with plain old kidnapping? Like if you unknowing confine someone lawfully - what does that get you?

It all just sounds like a system dreamed up by children who’ve watched a lot of Law & Order.

But I guess that’s a separate rant from the subject of Holly Bobo, so I’ll drop it.

I wonder if this idiot was trying to kidnap Holly for money? Holly is a 1st cousin to a country music artist Whitney Duncan. Whitney Duncan was never a major star. She only released one album and a couple of singles. I think she tours county fairs and other small events.

Maybe a redneck meth user thought he could get a big ransom? I doubt Whitney Duncan is very wealthy but he didn’t know that.

I’ve spent the majority of my life in the boonies and small towns and I’ll tell you for a straight-up fact that in a community that size, you don’t get that kind of rap sheet without everybody and their dog knowing you’re a violent tweaker asshole who shot his own momma. The entire county knew it was just a matter of time before he put a woman in the hospital or the morgue.

Someone steals a car, not realizing that the owner is passed out in the back seat, then crashes the car, injuring the owner?

The police sticking someone in a jail cell is obviously legal. Tying or locking up someone who attacked you before calling the cops, perhaps? And of course sending a kid to his room as a disciplinary method or just sticking a baby in a crib they can’t get out of; lots of things are legal for parents/caretakers to do to kids that would get someone else arrested, for obvious reasons.

Country singers rake it in, I hear; even those not quite in the caliber of Parton or Mandrell, and whose exposure is at best one or two gigs at Vegas.

I started this thread 4/16/2011. Almost 3 1/2 years ago. Holly has finally been found. Well, part of her anyhow. Hopefully they’ll find the rest in the next few days. At least now the family can bury their daughter and grieve.

Should make successfully prosecuting the men that did this much easier. So far four have been arrested for their involvement in this tragedy.

Sorry to hear this. I believe the above post deserves at least one response of acknowledgement.

It’s such a sad case. It strikes close to home. My mom reminded me that the Bobo family donated the land near Texarkana for my mom’s family cemetery. Over 4 generations are buried there. The last burials were in the 1980’s when my grandmother’s brother’s sons died and were buried there. We don’t really know if there’s a direct family connection with the people in this case. Obviously this isn’t an appropriate time to inquire about it.
