Another Bankruptcy Q Chap 7 - Required Education

My 341 Hearing was on 20 June. Within 45 days, I am required to submit proof of completion of yet another “Never write a check for more than you have in the bank” education course.
This seems to make a total of 3 total courses:

  1. Pre-filing
  2. Pre-discharge (goes by numerous names - it is a 2-hour, timed “read 2 paragraphs, click “Next”, answer the Q presented, continue” (this is the one with the brilliant bit of advice quoted above).
    3 Whatever this is called - the one due 45 days post 341 Meeting - google of “post-discharge chap 7” gets me yet another list of orgs offering the first two. Only one I’ve found in 2 days of searching even references this 3rd course (in its FAQ) and even it does not offer such a course.

So Q: In a Chap 7 bankruptcy, what is that last course, and where can I find it?

My lawyer (yeah, but she undersold the competition by 30%) is swamped after taking vacation,

yes, I know to see the Clerk’s office for a list if nothing else works. Getting to that office is physically challenging

There should only be two classes - prefile and postfile. It your 341 meeting of the creditors was on 6/20 you do not have a discharge yet - you will get that in the mail 6-8 weeks after the 341 meeting.

IANAL, IANYL, etc, and you should send your actual lawyer an email asking for clarification. Maybe there are different requirements in your district than what I’m familiar with.

I have several emails to my lawyer. whose letter stated:
"Your case will be over and you will be scheduled ro receive a discharge in bankruptcy after August 20th.You will need to return to a post-bankruptcy education provider for the final management credit counseling session. I can recommend t,u,v,x,y. You will need to give me the certificate of completion…

She had the cert of the second course when she sent this letter. In the one email I"ve received, she seemed convinced that I still have one to go - “Don’t worry, this one is basically just reading”. Which sounds quite different than the 2-hour Q and A second course.

I’m going to have to have a face-to-face.

It seems to me that your statement is correct - there are only 2, and she is unclear where I am on the map. Her last email acknowledged the 2 course as completed.

Let’s see…I went online, and took the prefile. After my discharge, I took the postfile. I just entered into the same website as the prefile, entered the same ID, and they directed me from there. This was last year.

Took the lowest bidder, everything went like clockwork.

Funny it was not included in your fees as part of the program, regardless you should have received some type of instructional paper on it??? Odd!

A: No, the Bankruptcy Code requires individuals to complete credit counseling before filing for bankruptcy, subject to certain exceptions, and requires debtor education to be completed after the bankruptcy case is filed. Therefore, an approved agency may not offer both services to clients in the same session.

The “papers” I have received are the problem - the booklet handed out (with the fee amount written on it) is a combo of asset/debt lists as well as basic overview of the process.
The letter sent post-file is about exact steps - this is where I think we crossed wires - I had already completed the second course, and had gotten an email from her stating the certificate had been filed (“I filed it with the Court” sounds more impressive than “I forwarded the email"to the Clerk”).
The form letter was for those who (apparently, typically) had not, thus the “must return”.

I am usually memorable (sense of humor and quite sharp) - I was the only person in the 341 hearing room in a 3-piece, for instance - it hurts that she didn’t remember me enough ttto know I had aleard done the silly course. Course completed 5/25; 341 6/20.

Look like I’ll have it nailed by E-O-D today.

For those watching (both of you): In CA at least, there are only two courses - the second is a 2-hour timed (must spend at least 2 hours, can take longer) grade-school “what banks do” type ting with Q’s every 2 paragraphs
