The court determines if your guilt can be proven to a sufficient degree to warrant punishment. The whole point of going to criminal court is to determine if the gov’t can punish you in some way. You think the gov’t is going to run a whole trial just to figure out if you did it? With no expectation of punishing you? Nonsense, they want to prove you guilty so they can punish the act appropriately.
You do not have to prove something true in order for it to be true.

I can tell you I have been to Cuba and the government clamps down on prostitution of any kind more than you can imagine. The fact is any country where people are desperately poor is going to have prostitution and Cuba is no exception. A minor part of that may involve underage women and I doubt there is any child sex in Cuba to speak of. The fault of that does not directly lie with the Cuban government but with men from rich countries, beginning with Europe and North America who go there to commit criminal acts. I can guarantee you that if caught they are in deep shit as they should be. I can tell you that a couple of years ago the Cuban police were clamping down on prostitution and just talking to foreigners earnt a few days in jail. I know it because I managed to get two young women in trouble that way and they were taken away by the police and I never saw them again.
