Where do you get that conclusion from? He didn’t retreat, in the sense that he was diffusing the situation. Upon seeing the girl go behind the counter, he went back to get his pipe. Using the word “retreat” paints him as trying to end the situation peacefully, as opposed to the reality of the situation; a psycho going to get a weapon to inflict great bodily harm.

We’re talking about twenty-five seconds from the start of the assault until it’s over. That is nowhere near enough time to calm down from a fight-or-flight adrenaline response and start thinking rationally.
Further to that, according to eyewitnesses, “McIntosh ordered his assailants to stay down, and belted them each time they tried to get up.” (You can see on the video that he is speaking to them, but can’t hear what he is saying over the shrieking of horrified customers.)
In the context of a ten-year stretch of hard time followed by only six months of burger time, I don’t find it hard to imagine that he would still read “attempting to stand after receiving advice to the contrary” as “credible threat.” Hell, that’s SOP for the cop on the beat - because otherwise, you’re gonna get hurt. Also, based on the women’s demeanor and behaviour, I don’t find it hard to believe they may actually have still had some fight in them.
I amn’t about to waste much sympathy on violent assholes. (Also not broken up by the thought of him going back to the slammer as an ultimate consequence of being the victim of a random assault, per the same principle.)
Here’s a brilliant idea, how about to the nearest phone to call the police, which in my experience with McDonald’s, was right by the second (food-dispensing) drive-thru window probably about five strides from where he was standing when he was slapped.
And by virtue of size and strength, there was more than enough manpower in the kitchen to get her back around the counter and/or subdued until police came without using an offensive weapon to beat her to the point of grave bodily injury.
And this is the disconnect from logic that drives so much police brutality, because when someone is standing over you, and is beating on you with a weapon, and you’re vulnerable on the ground, you aren’t going to stop trying to get up and flee until you’re so injured that you can’t. Every instinct in the human body says get the hell away from this danger, and even moreso when that person is continuing to beat you and yelling at you to stay still so that, presumably, they can beat you some more without the interference of all your annoying movement. Expecting that they’re going to stop trying to get up and away is fucking ludicrous.
And which is why it’s generally illegal to beat people with clubs and pipes, especially unarmed people, and especially once they’re down on the ground.
And notice what this felon never tried? *Threatening *them with the pipe, saying GTFO from behind this counter or I’m gonna smack the hell out of you. Instead, he just came out and started swinging, giving them no opportunity to do anything but try to defend themselves from far more serious injury than they could’ve ever given him, especially since they were, in fact, drunk, and not large women.

Defend themselves??? The women were the aggressors here. One hit him and then they both went after him. Women are far more vicious then men when it comes to inflicting physical injury during a fight. I do not blame him at all for taking down two crazy bitches before they hurt him, and clearly that’s what they were determined to do.

I have. Many times. (4 years in Security, but a few calls when not)
Surrender the fantasy that they come rolling up a dozen squads at a time in mere seconds. More often than not, a single squad comes rolling by 45 minutes to an hour later and may or may not actually stop. Hell, one call to Police on a security gig, they straight out told me they could not respond and I was on my own. For a violent incident involving multiple people at an inner city mall!
I didn’t see the video, so I cannot comment on his actions. But the idea that he should step back and call the police is a complete fucking fantasy.
I didn’t know that this thread existed when I posted my thoughts in the Pit. I will give odds that almost none of you posting that he went overboard have ever been attacked or in a true “flight or fight” situation. In short, you haven’t a single clue as to how you would have reacted in a similar situation.

None of that manpower lifted a finger to help when he was attacked. None of that manpower lifted a finger to get either trespasser back around the counter and/or subdued, either. I very much hope if the guy is prosecuted, it will be in the news and a fund will be set up for his defense. I would contribute.
Did you watch the video? I assume from video evidence that the fist attacker, assailant number one, received the fracture from one of two very prominent blows by the defendant. Number one… the initial blow, the very first ward, as the “beatdown” begins, he hit “shorty” in the temple. about two seconds in he is attacking the second assailant to arrive on the scene, the one whom I assume simply was lacerated. Then he turns his attention about 4 seconds into the defensive attack, back onto shorty and connects with the back of her head AND SHE GOES DOWN… oNE OF THE TWO YIELDED THE FRACTURES SKULL.
The telling part is that she probably incurred the broken arm as a defensive wound oin the ground.
