The Trump legal team has responded to the DOJ’s request to the judge to continue working with the classified documents. These lawyers don’t seem to understand the law very well. Someone should point them in the direction of the Presidential Records Act…

Their argument seems to hinge on the theory that the records, including highly classified material are Trump’s personal property, and he can do whatever he wants with them. I suppose even sell them to foreign intelligence services for cash, if he so chooses.

I figured all along that – after all their bullshit excuses fell apart – they’d eventually settle on a “huge overreaction to a paperwork error” narrative. So yeah, they’re calling it “a document storage dispute.” Nothing to see here, folks.

If only some past president had harshened up the penalty for mishandling classified documents.

Bump. No one else has any theories as to why the Trump team would nominate a guy who approved the Carter Page surveillance as the special master?

I’d have to go with the “there’s only one right choice here, Cannon.” theory.

Otherwise, all I’ve got are 1) incompetence, or 2) they have some reason to think that he’s slow and overworked and that he’ll take a long time going through everything? Incompetence would be my preference between those two but, as said, “there’s only one real choice” is my winner.

I wonder what the chances are that Cannon was surprised by the amount of criticism she received and will try to balance things out (salvage her reputation) by picking a DOJ choice for SM and ruling in their favor on Trump’s latest filing. I know, slim. But on can hope.

The part I still don’t understand is why anyone, the DoJ included, is paying any attention at all to this judge. She doesn’t have any sort of jurisdiction in this case, and even if she did, no judge has the authority to order the DoJ to stop an investigation.

Surely there have been crazy judges before, who have issued proclamations ordering the government to do crazy things, and they were just ignored before? If some random judge were to decree that Biden wasn’t allowed to issue any more executive orders, Biden doesn’t need to go through the trouble of appealing that before he can continue Presidenting, does he? If so, how does our government ever function?

I’d like an answer to that, too, from one of our own Legal Eagles.

The DOJ is open to one of Trump’s picks for special master. Maybe they didn’t want a drawn-out battle, but there has to be a catch with this guy.

The catch is that the DOJ objects to having a special master at all and expects the appeal court to rule in their favor.
