If the Supreme Court announces tomorrow that they will give their ruling on June 10th 2023 (assuming that is the last day of the Supreme Court session), is there anything that the DOJ can do?

If they do nothing until June, it’s status quo until then. So that’s fine. The worst thing would be Thomas stays it and the entire court doesn’t overrule him.

From my quick reading - it seems to fail the same smell tests of so many of their past filings. I can’t wait for the DOJ response.

I think it’s posturing. They have to show the people that they are begging money from that they are doing “something”. But it won’t go anywhere. Not even with this set of judges.

OK, now I am really confused. This legal stuff never seems logical, at least to me.

After the 11th Circuit issued their stay, Judge Cannon revised her order so that the “documents with classified markings” were not covered by her order. This would make the the stay issued by the 11th Circuit impotent (I am sure there is a legal term here that I am not aware of). That is, even if the Supreme Court were to block the stay, it wouldn’t have any effect since Judge Cannon’s order does not allow the “documents with classified markings” to be subject to the Special Master.

What do I have wrong?

if i understand it, team trump are stating that judge cannon’s ruling was non-appealable? that the district did not have jurisdiction to remove the stay? is that what i am reading?

The Department of Justice is appealing everything that Judge Cannon did in this case, because it wasn’t her jurisdiction to begin with. There shouldn’t have to be a special master at all, nor the opportunity for him to rule anything privileged.

There are probably also some non-classified documents the DoJ found that they’d like to use in building their case, and as of right now, Cannon’s ruling that they can’t use those until they’re specially mastered is still in effect.

In the latest LegalEagle video (which is from the 29th of last month, so doesn’t reference the very latest twists and turns in this case, which seems to have something new every day), Devin Stone basically said there shouldn’t be anything to appeal to the Supreme Court. Here is the video, I tried to timestamp it to that part of the video:

That is how I was thinking. As it sits now, the stay has no affect on Judge Cannon’s Order. Sure, she could revise her order, again, which could make the stay meaningful, but she could also do a lot of things. I didn’t think the Supreme Court would look at hypothetical cases.

I understand all that, and I suspect that when that happens (the full court opinion on the DOJs appeal is issues and the whole Special Master issue is thrown out), Trump will appeal that to the Supreme Court. But, to appeal a stay that, technically, is no longer in effect?

Delay, delay, delay, even if the delay is nonsensical.

I’m going to go on record and say that even Thomas wants no part of this particular shit-show. He knows he’d be overruled and he has other shit to worry about. My guess is that he declines this hail-mary and the 11th takes Cannon off the case altogether and the USSC declines to get involved in that one either.

CNN’s legal analyst opines that if Thomas opts to consider the appeal, he will have to refer it to the whole court. More likely, he’ll just use his own discretion to decline to hear it. Unless the whole nation’s justice system has gone down the toilet, this is just the orange shit-gibbon grasping at straws.
