There needs to be a written policy explaining just how much deference this asshole must be shown as opposed to your regular private citizen. Anybody else, afaik, would be at least interviewed by the feds if there were questioned regarding top secret documents.

On what basis can the feds compel an individual to be interviewed?

Maybe after government documents which he claimed he didn’t have were found in his lair. Now there’s suspicion he’s with holding more. Is “probable cause” a thing?

What statutory basis is there to compel a private citizen to be interviewed by the feds? I would have thought that the right to remain silent means that you can’t be compelled to sit an interview. But I’ve been wrong before about US security laws, so I’m curious if the feds have that sort of authority?

As far as I know, he doesn’t have to talk to anyone, even if he get’s arrested. They can ask, but he doesn’t have to tell.

Unless he is forced into a plea deal. Jail time or publicly admit to your sedation and remove yourself from political activity.

I don’t know that the really “had him” as far as the planted documents go. All that crap was said purely for the rubes. I don’t think that accusation was raised in any legal filing (precisely because they would have to put up or shut up). So all that really matters is how it was perceived by the general public. And those who are open to reason already realize that there was no evidence presented, while those who aren’t won’t be convinced no matter what.

That is the problem. This is an unprecedented situation. In theory, this should never happen, because a person like this should never have gotten so far as to be elected to such a sensitive and powerful position. This is like asking what policies you have in place for when a Kindergarten teacher goes on a PCP-fueled rampage.

It’s clear that they may have to develop a policy though after this circus.

Well, if a suspect, generally none- that is what the 5th is about. A Grand Jury, etc can order someone to testify if they are given immunity.

If a witness, they can be compelled to testify via subpoena, etc.

Civil matters, which these lawsuits- are have different rules.

Not usually. They would have to convince a judge that by testifying , that testimony could be used against them in a criminal action. I saw it happen once. But our SDMB lawyers are likely better experts.

Mind you- I didn’t carry a gun or anything. My job was to bring Civil charges, and to assist the various Law enforcement dudes in a Criminal Money Laundering investigation. I sat on a couple Joint Crime Task forces, but I was the low man on those, for sure. So yeah, I sat in some Courtrooms, etc and listened to the US Attorney and FBI etc discuss high profile cases (but I was informed that I had to shut up unless they asked me a question). My big compliment was when the Lead FBI dude said “well, even if the Cartel kills or intimidates all our best witnesses, as least Deth here will come up with that sure-fire ‘99 counts of wire fraud and money laundering’”.
