As I understand it, certain secrets related to the nuclear program are NOT declassifiable by the president, at least not without going through a specific process which involves various agencies. Can anyone confirm this is true?

Also, over in MAGALand, they argue that the constitution gives any president absolute authority over classified documents, and as such any such law would be unconstitutional. I’m presuming this is patently untrue, but I’d be interested in opinions on that as well.

Classification doesn’t even matter in this case. It’s a red herring. The threshold issue is whether revealing the information is a threat to national security.

I get what you’re saying, legally. But there’s a political element here as well. And if you lurk on Trumpie-sites, it’s an endless chorus of “Biden had documents too! And he wasn’t even President when he took them” as well as “But he declassified them!”

I want to see Trump strung up as much as any of you. But I also recognize that if we don’t convince enough of his supporters that this prosecution is legit, it won’t make things better.

Let’s just agree that 30% – a sizeable number, I’m afraid – are a total write-off. Nothing is going to dissuade them from their defense of Trump. It’s sad, but it’s true.

I do believe that enough of the remaining 70% are either persuaded or persuadable.

We’re in for a very rough ride for awhile. It’s an existential crisis for the country, for sure.

My gut says those numbers are about right. I’ve certainly seen some Trump-supporting relatives decide maybe he wasn’t all that. They still like his policies, but not so much him.

If we can convince the 70% then we take a big step back from the existential crisis. If not, then something like 30 or 40% of the country literally thinks the government is illegitimate. That’s dangerous.

I saw some poll results this morning that reflected that 82% of Dems and 62% of independents are already onboard. So that’s a good start. (I’m trying to find the poll, but I want to listen to Smith’s presser first.)

He’s not in trouble for taking documents. He’s not in trouble because they were classified. He’s in trouble for keeping them after receiving a subpoena to return them, for lying about having turned everything over when he hadn’t, and for showing national security secrets to people who didn’t have clearance to see them. Not that the great unwashed will ever accept that mountainous distinction.
