I hope you pointed out that he didn’t legally own the documents, and pointed out that literally the first thing in it after the Definitions is:

§ 2202. Ownership of Presidential records

The United States shall reserve and retain complete ownership, possession, and control of Presidential records; and such records shall be administered in accordance with the provisions of this chapter.

This is why usually I don’t refer to this situation as a mishandling of documents. It’s theft.

If someone who worked for a research laboratory took a bunch of plutonium the day he was fired, and then let it sit in his front yard as it irradiated the neighborhood and mutated the local pigeon population such that they started to rampage and terrorize a nearby outdoor market, you wouldn’t call that a mishandling of hazardous materials. Someone stole something dangerous, and it had terrible consequences. That’s what I equate this to, except consider that the “neighborhood” is the entire nation, and the mutant pigeons may not have yet revealed themselves.

I don’t think they know that. Or that maybe someone like Obama didn’t legally own his documents but those rules obviously don’t apply to the Dear Leader. Or they may know it but don’t care because his taking them owned the libs. The MAGA crowd is not grounded in reality in any way.

The arguments with the true believers always revolve around whether he had the right to possess the documents, and whether he had declassified them. It’s a never ending circle with them and pointless.

However, to my understanding nearly anything can be subpoenaed, and it doesn’t matter if that thing is “yours” or if your have rightful access to it. They can subpoena my shoes, my hard drive, my phone, the fireproof box where I keep papers I want to protect, etc. Even though it’s not in doubt that those are all mine and having them, doing what I will with them, is entirely my right.

BUT, once subpoenaed, any non-courtroom activities I take to lie, hide, or mislead about the handover is a felony, even if there’s no question of my right to the object, and even if the object presents no useful evidence of any kind.

To me, that’s the most difficult to argue with, and if there’s any hope of convincing someone otherwise disinclined to believe it, that Trump committed a crime, that’s the spot. Assuming it isn’t just hopeless.

Sometimes people mention that car dealers/repair shops near them have Faux News on the TV. South suburbs of Chicago checking in from a Firestone, and ABC is on here. I just glanced around the waiting room, and everyone here was watching.

That seems be the case. I am a state government worker, and we are warned not to use personal devices (or personal services like our personal email accounts) for work purposes, most especially if there is a possibility that data may be saved on that device either intentionally or unintentionally. (Actually, as an IT professional, I’m usually the one warning other people about that.) The reason is because if there is an investigation into wrongdoing on your part, or even if there is just a disclosure request, we are required by law to provide anything we have that might have work-related data for discovery purposes. If you texted someone from your personal phone, you might have to give that up temporarily. That just goes with the job. I imagine a subpoena works the same way. Your right to personal property is secondary to the pursuit of justice under the law.

It’s also the reason why you have to let people into your private space if there is a warrant.

this motorcade is ridiculous! 7 lanes of traffic at a stand still while 20+! 20+ vehicles take 2 men to a court house. there is an ambulance in this clump of vehicles.

I was just watching an Al-Jazeera piece on the courthouse which called attention to the “dozens and dozens” of reporters and “a few scattered protesters.” That was about noon and it’s still early. But this may be New York all over again.

How strong is the case if Judge Cannon rules that none of the attorney-client privilege can be waived? Can she tank the case just by doing that alone?

The on-ramps have been blocked too. Just saw one at a dead stop. I’m sure they will be opened when the motorcade passes, but still. This is more like a parade than a simple trip in a car.

i always thought having a motorcade just calls more attention to it. just put him in a protected car and be done with it.

It’s still pretty strong. His showing some documents to other people doesn’t seem to rely on the lawyer’s testimony at all. Demonstrating that he produced a false document about having given back all the documents seems to rest on that document itself, which cannot be privileged, since its whole purpose was to respond to the government’s inquiry. The unsafe storage and transport can be proven with those photos, which they got off phones belonging to other staffers, not lawyers.

A few counts might fall if the lawyers are excluded as evidence, but the rest are still pretty strong.
