Between the signature orange color, and the fact that the Orange Lantern power ring is driven by greed…it’s uncanny. 
The other point I would add is that courts usually are not stupid (as we found out when Team Trump lost something like 65 out of 66 “election fraud” lawsuits). It really pisses judges off when they hear an obviously disingenuous argument, like “but yerhonor, when my client said every night on prime time Fox News – for two straight months – that the election was stolen due to fraudulent voting machines, and that there is solid proof that Dominion and Smartmatic voting machines are complete shit that were programmed to throw the election to Biden – no question about it, my client was merely expressing a humorous opinion (ha ha!) as is his right under the Freeze Peach provision of the First Amendment”. Judges didn’t go to law school and eventually become judges in order to have their intelligence insulted.
The fact that I am wearing an Orange Lantern t-shirt as I type is making me giggle inordinately.

I am not sure in a slander lawsuit that saying, later, that you misspoke, “I’m sorry,” really helps you.
But IANAL.
It depends on the timing – the longer the defendant waits, the worse it gets. Remember that there are compensatory damages (actual damages) and then punitive damages, the limits of which are set by statute. For punitive damages, jurisdictions will take mitigation efforts into consideration. And it’s possible that taking mitigation steps may get the plaintiff to calm down.
The overwhelming majority of lawsuits happen because plaintiffs are pissed off and feel that a lawsuit is the only way to get someone’s attention and a pound of someone’s ass. Anything a defendant can do to calm the plaintiff down is probably going to be encouraged by a defense lawyer.
Makes sense to me.
There are two aspects to this:
- Did person-A commit slander?
- If person-A did commit slander what were the damages? The sooner person-A renounces what they said the more limited (probably) the damages.

Damages are often estimated; it’s hard to come up with an actual dollar amount, especially when we’re talking about potential lost income and lost damages. I believe that, like insurance companies, law firms actually have quantitative analysts calculate that sort of thing, with complex formulas and such, lol.
Retractions are often used to influence the calculation of potential future damages (non-punitive). But they also get people to calm down, which makes something like settling out of court a little easier as well.
I would not be at all surprised though if FoxNews did have “contingency plan A/B/C/etc.” in place as to how to reposition their lineup and cover their asses depending on what happened with the election, including determining what personalities continue to be useful enough to be worth their cost (Dobbs apparently for all his viewers was not generating great revenue). That would be reasonably expected of anyone in such line of business; Murdoch’s team are evil, not feckless. However they surely would not have expected the specific kind of mad spiral that did ensue, or to wind up with billion-dollar litigation on account of encouraging their on-air talent to ride that crazy train all the way off the end.
I flipped through the Fox shows every now and then post-election, and Hannity and Tucker were nowhere near as bad as Dobbs and Bartiromo.
Basically, Hannity and Carlson did things like blow the isolated cases of real fraud out of proportion, imply that the pandemic driven changes to voter laws allowed people to request and fill out multiple ballots, imply that there were large numbers of forged signatures that weren’t caught because of rule changes.
A typical segment might be the host ranting about all these places where there were 50, 75, 100 ballots coming from the same address, all witnessed by the same person, and no one is investigating…
What they fail to mention is that’s what it looks like when the address belongs to a nursing home. My mom voted from her nursing home during the primary and the activities director witnesses all the ballots.
So misleading as hell,and vile - but they really made sure to walk the line and not lie outright, they steered clear of the Dominion - Smartmatic stuff, and disclaimed it on the spot if a guest let let it slip…“Sorry to interrupt you, but there is absolutely no evidence of that”.
Fox Business on the other hand, was worse than Fox by several orders of magnitude. So much worse there’s really no comparison.
I don’t remember the name of Dobb’s show, but it was full on Trump porn. If they had changed the format so it consisted of Lou stripping down and sucking Trump’s dick and balls for an hour each night, it would be marginally less offensive than the current format. Dobbs and Bartiromo are worse than NewsMax and possibly OAN.
I think it’s a target rich enviroronment for video clipping every one of them to the finest detail and making their public lives hell for their hypocrisy until they apologize and withdraw completely.
I watch them all and they have been lying many many times substantively, on life and death isssues as it turns out, on each daily show. For 5 years now. They must pay in the public square. They are refusing to be governing partners with sane people, for christs sake.
Yeah, well given what they had to work with I’m not surprised.
