I heard part of that on NPR a couple nights ago, with Noem saying that habeas corpus is a right granted to the President. Hassan should have let her run with that. Get Noem on the record saying it’s a sacred right enshrined in the Constitution, and should never be suspended under any circumstances. Let her find out later what she was defending.

You can’t possibly give a more wrong answer than that. It’s literally the opposite of what it means. When the head of the DHS can’t define habeas corpus, a right going back to the Magna Fucking Catra, without giving a 1984 definition, things are truly fucked.

Yes, exactly. If that’s what Noem thinks habeas corpus means, Sen. Hassan should have followed up with something like “should habeas corpus ever be suspended?” Presumably, Noem would have answered “no, never.” Keep asking questions like that; get Krisiti Noem on the record as a passionate supporter of the right of habeas corpus.

If she later finds out what habeas corpus really means, leave it up to her to admit it.

Did we watch the same senate floor footage? What is there to possibly gain by allowing Noem to continue rambling on about her lack of understanding (the literal opposite of its actual meaning, in fact) of the meaning of a basic legal term (lit. “you should have the body”, as in a writ of habeas corpus requiring the government to present the body in question in front of a judge to determine if he is being held in government custody properly and legally) that dates back to the year of our lord 1215. There is nothing to be gained by doing that instead of shutting down her gibberish response and correcting her while pointing out that she has no fucking clue what she is talking about.

It has nothing to do with law enforcement and everything to do with the legal system. Habeas corpus is the bedrock of the legal system in keeping the law enforcement system in check. It ensures that due process is received. A writ of habeas corpus demands that the government present the person in question being held by law enforcement before a judge and explain why he is being held, on what charges, and the basis of this imprisonment. And god help them if they can’t answer those questions to the judge’s satisfaction.

Why is this important? Because TFG’s administration has already flaunted it, along with basic respect for the rule of law and the judicial system, including rulings issued by judges TRG appointed during his first administration, and want to do away with habeas corpus.

White House ‘actively looking’ at suspending habeas corpus in immigration

White House deputy chief of staff Stephen Miller said Friday that President Trump and his team are “actively looking at” suspending habeas corpus as part of the administration’s immigration crackdown.

“Well, the Constitution is clear — and that of course is the supreme law of the land — that the privilege of the writ of habeas corpus can be suspended in a time of invasion,” Miller told reporters at the White House.

“So, it’s an option we’re actively looking at. Look, a lot of it depends on whether the courts do the right thing or not.”

Unfortunately for him, courts have been doing the right thing, rather than the wrong thing and the thing TFG wants, which is what he means by “the right thing”

Suspending habeas corpus, as a result, would be highly controversial. But the administration has already taken controversial steps as part of its deportation regime, such as triggering the 1798 Alien Enemies Act.

The Supreme Court directed migrants to challenge their Alien Enemies Act deportations through habeas corpus, and since then, judges in at least three cases have sided with migrants, determining the Trump administration was improperly using a law meant to address warfare and incursions.

It’s possible judges might have a similar interpretation of efforts to suspend habeas corpus, as challengers would also likely dispute whether the U.S. is currently experiencing rebellion or invasion.

Vladeck went on to say that the comment read like a threat to the courts, adding that Miller is “telling on himself” by saying the White House’s actions depend on court rulings in immigration cases.

“It’s not the judicial review itself that’s imperiling national security; it’s the possibility that the government might lose,” he said.

From Noem’s dumbass reply to the question, we are steps away from the next type of answer to be, “God did it!” Then adding, “Trump said so!”

I think Noem knows exactly what habeas corpus is. She just played dumb because it was easier than telling the truth. She has nothing but contempt for Congress. She knows she will not suffer any consequences for her answers and MAGA will love it. She and the rest of the administration will continue their performative bullshit at these hearings until they decide to quit pretending that Congress is relevant.

That smirk they use to deliver bullshit, which they don’t even care if what they say is true or not, is the arrogance of getting drunk on power. Defying the nation: “Don’t like it? What are you going to do about it? We crush you either way.” They aspire to wear the boot that stomps on the human face—forever.

Where do you get Biden from? I thought TFG was a very well-known acronym around here, and TRG was a typo. TFG stands for either “that former guy” or “that fucking guy” depending on how you are feeling. Biden was the one who coined it.
