How does Limbaugh justify himself? (Rush's arrest thread)

Rush Limbaugh has been detained at Palm Beach International Airport for the possible possession of illegal prescription drugs Monday evening.

From April, 2006, when the original bargain was filed in court. Might have been the first day or so of May, but certainly not earlier. The events themselves go back a bit more, but that decision not to prosecute was made with a proviso that Mr. Limbaugh not break any laws at all for the next 18 months. The apparant involvement with drugs, is not just a failure to obey the law, but a drug related law as well.

And yet again someone pops up with that comment. Do you think that really has any bearing on (a) fact or (b) the topic in this thread?

I’m not clear on this: is it illegal for a celebrity who really would have rather it not be known that he needs or wishes to use Viagra, to have one physician prescribe something for him, but to write it to another physician? Is it illegal to possess a bottle with pills in it, which does not have your name on it? (I know it is illegal to take somebody else’s medications, but possessing a bottle is not the same as taking.)

Assuming the two physicians in question were asked, and both of them were in agreement that yes, the prescription WAS for Limbaugh, but they didn’t want somebody at Pharmacy X giong to the National Enquirer with the hot news that Limbaugh needs Viagra, could they write it one physician to another, and get it for him that way? Or would that be illegal?

IANAL, but I’m guessing, since they detained him, that yes, it would be illegal. Here, it has to be your name on the prescription.

The pharmacy has the obligation to maintain client-patient confidentiality, so there is no reason to use someone else’s name. I’m no lawyer, but I don’t believe that the practice of writing it in someone else’s name is legal or ethical. Rush broke probation,now time to throw the book at him.

In fact I do not have prescriptions for my Viagra, testosterone or Prozac. Why should I? I don;t need one here. I wonder if I am at risk when I fly home?

If he broke probation, yes. Unless you’re a Florida lawyer though - and every news article I could find last night said he was ‘questioned and released’, and that the local law enforcement was only thinking about charging him with a second-degree misdemeanor, not that he was actually charged - I doubt you can be any more certain than I am. And I’m not certain.

IF a doctor wrote a prescription to another doctor, and the second doctor gave it to Rush, and IF that is illegal in Florida, then it seems to me the people who broke the law would be a list including the 2 doctors and Rush, and the doctors would be in deep doo-doo because they would CERTAINLY know they were breaking the law to write such a prescription.

What it can’t be, is doctor shopping. With doctor-shopping, you find doctors who know nothing about each other, to write you prescriptions for narcotic or other drugs. This is what Rush was originally accused of. Whatever this instance is, it’s not that, and it probably belonged in a new thread of its own. You know, maybe one named ‘Rush has a limp dick!!!’ Put into this thread, it looks like viagra is somehow tied in to oxycontin. It isn’t, except and unless the Florida authorities do charge him with this misdemeanor. And it is proven a valid accusation in a court of law.

By all means, if the doctors were behaving illegally go after them too. But Rush seems to think that laws don’t apply to him and his supposed right to avoid using his own name in the pharmacy justifies ignoring those laws.

Just want to point out that there’s no requirement to find him guilty of a crime first. The judge in the first case may decide he violated the conditions of his probation without a guilty finding based on this second charge. The mere fact of his arrest could sustain a violation of probation.

As you point out, he hasn’t been arrested either.

Probably the worst thing that can come of this is that Rush’s fans will now know that he has sex. Arch-Conservatives aren’t allowed to do that, are they?
