Not yet. That’s one of the many Trump innovations that is probably eventually going to produce a spate of new laws governing the actions of the Executive Branch.

Things like holding press briefings or releasing tax returns or removing financial conflicts of interest have so far been left in the sphere of custom and tradition rather than explicit legal mandate, because it was always assumed that anybody who could get elected President would have at least the rudimentary level of deference for the appearance of probity and responsibility to perform them.

We have learned from Trump’s Presidency that that assumption is not necessarily valid. So at some point, we are likely going to decide that the only way to ensure responsible behavior from a President is to enforce it legally. Even that is going to have far from perfect results, of course, but at least it will have more effect than simply leaving such matters up to the POTUS’s personal sense of duty and good reputation, of which, as President Trump has demonstrated, it is actually perfectly possible for a POTUS to have none whatsoever.

That’s the thing. Even if these “customs and traditions” were actual laws, who is going to enforce them on thump?? NO ONE, that’s who.

The customs and traditions don’t need to be laws for normal presidents who understand the gravity of the office (you know, what Mike Pence said). In thump’s case, these things being law wouldn’t make any difference.

Heard a new one today from a friend of mine who is trans. Apparently a lot of trans people are having problems getting their passports renewed. Even though their passport lists them correctly as their current gender when they submit for a renewal they’re being denied because there’s an “error” in the listed gender. It’s not a complete denial; they’re just being told they need to submit further medical documentation (no word on whether anyone has succeeded in getting a renewal after submitting the extra documentation).

I say this is just harassment. Your current passport should be considered adequate documentation for a renewal. If you were issued a passport as a woman ten years ago and you’re submitting for a renewal to that passport as a woman today, there’s no reason why what gender you may have been more than ten years ago matters.

Apparently it’s Pompeo, not Trump, who initiated this change. But I’m going to blame Trump for picking Pompeo for the job.
