WASHINGTON — Donald Trump is asking a federal judge to dismiss criminal charges against him based on his actions leading up to his Jan. 6, 2021, coup attempt because, as president, that coup attempt should be considered part of his presidential duties.
Trump lawyers Todd Blanche and John Lauro, in Thursday’s 52-page filing to U.S. District Judge Tanya Chutkan, attempted to minimize Trump’s actions leading up to the violent assault on the Capitol that day and that, regardless, the law allowed Trump to act based on his belief that the election had been stolen from him.
As my wife would say, interesting. And she doesn’t use that word as a compliment.
Actually, it is an interesting question. If Trump ‘truly believed’ that the election was “stolen”, then it sorta makes that as CIC he could defend the Country and Constitution any way he saw fit.

If House Republicans can’t reach consensus on a candidate to replace the deposed Kevin McCarthy, R-Calif. , “they have asked me if I would consider taking the speakership until they get somebody longer-term, because I am running for president,” Trump told Fox News Digital.
He added: “They have asked me if I would take it for a short period of time for the party, until they come to a conclusion - I’m not doing it because I want to - I will do it if necessary, should they not be able to make their decision.”
The former president also told Fox News Digital that he will travel to Washington, D.C., next week and plans to meet the congressional Republicans about picking a new speaker of the House.
Hasn’t it been established that he knew full well he legitimately lost the election? And “any way he sees fit” doesn’t fly in the US, IIRC.

Rule 26 of the Republican Conference rules for the 118th Congress, Temporary Step Aside of a Member of Leadership who is Indicted
(a) A member of the Republican Leadership shall step aside if indicted for a felony for which a sentence of two or more years imprisonment may be imposed.
Although not a member of Congress, if Trump becomes Speaker of the House he would then be a member of the Republican Leadership, as defined in Rule 2.
If Trump honestly believes he won the last election in 2020, and many of his followers believe he’s actually the “real” president even now, then they should understand he’s ineligible to run in 2024 since you can’t be president for more than two consecutive terms.
Well, yeah, you and I along with anyone else with functioning brain cells know that. But didn’t the Craven Cantaloup already claim he should get a Mulligan for the initial term?
It gives an excuse to reject someone you don’t want. And until it inconveniences you and you decide to ignore it, it’s something you can point to in order to show you have standards and care about integrity.
In normal times you wouldn’t want someone with a major indictment leading you because it would poison everything you do. Now, being indicted is practically an initiation for the Republican Party.
Agreed. No one who enables such villainy, even if that’s the extent of their participation, is fit for office. And I had never voted for a Democratic presidential candidate prior to 2016 (I’m 62). Trump turned me into a bleeding heart registered Democrat. The GOP? They can fuck right off.
