First let me say, that I don’t buy ‘my’ argument. It was just a theoretical.
On the other hand, though, it shouldn’t be dismissed out of hand. Not only because Trump may, in fact, use such a ‘defense’ according to the Huff Post link above, but also because, as his lawyers argued, the very purpose of allowing a POTUS absolute immunity is to permit him/her to take decisive action in an urgent, nation-threatening situation without fear of criminal consequences.
Which is very easily abused, and that’s why that isn’t a thing. The POTUS is not above the law. Nixon found that out, and Trump is finding that out.
The POTUS should absolutely fear criminal consequences prior to committing a crime. We don’t want to be a nation run by criminals. (Most of us at least.)
Unfortunately, his definition of an urgent, nation-threatening situation was him losing the election. As a couple dozen of his henchmen and several hundred of his mooks have found out, that reasoning is specious. Now it’s his turn.
