Bush could have pardoned DeLay preemptively, if he wanted to.

There is some speculation that he will be pardoned by Rick Perry, the governor of Texas.

Personally, I think his conviction (and, hopefully, imprisonment) is Terri Schiavo’s revenge.

I doubt Perry will pardon him. Perry is a potential presidential candidate. Pardoning Delay would be a risky move.

Right, good point. I keep forgetting that this isn’t a federal case.

Does he get to roam free while it’s being appealed? The government should meet its burden before taking away the freedom of any citizen, and DeLay is entitled to whatever legal avenues are open to him. But as things stand now, he is a convicted felon. When a death row inmate appeals his sentence, he does it from behind bars. Will DeLay really avoid the big house by stretching out his appeals as long as possible?

life is way too long. I’d think that 40 years would be sufficient, even for Texas style justice. It just might stop people from money laundering if they can see that “the hammer” would get a really long sentence. His lack of remorse in his “this is bullshit” statement might come into play too.

DeLay’s has gotten away with so much shit over the years that I’m surprised (and pleased) that he was found guilty. I thought for sure that he’d somehow escape conviction and make a big political comeback.

Rick Perry cannot unilaterally pardon Delay. Texas restricts the governor’s power to grant any form of clemency, which includes pardons. Here is the text from the relevant Texas state web page:

Sentencing is Dec 20. he could get life for money laundering. e also was found guilty of conspiracy. That is another 2 to 7 years. There is a possibility of 20 thou in fines too. He will appeal. His claim is he got an unfair trial in from liberals. Can’t get a fair trial from Austin,Texas liberals.
