Scenario: The Republicans find a right-wing Black female judge and promote the shit out of her as being the perfect moderate “compromise”.
Yes, holds are still a real problem on low-level nominees like assistant deputy undersecretaries for pen procurement, where they might not be worth burning up floor time on the cloture process and an individual recorded vote, but it’s not even a speed bump on a Supreme Court nomination. Every Supreme Court nomination since at least Samuel Alito has required a cloture vote.
Well, the 14th Amendment only applies to the states, but the Supreme Court has miraculously found an equal protection component in the 5th Amendment even though it says absolutely nothing about it. I would think that the courts would want to stay out of this fight, but if a president announced that he wanted only white male Christian conservatives, I think the left would be demanding court action that all of a sudden would not be considered “Trumpy.”
I was wrong, Sotomayor nor Kagan both moved to the floor by unanimous consent (but they both had well over 60 votes so it wouldn’t have mattered either way).
If they get rid of Biden and Harris, next up in line of secession is Pelosi.
No, once they have the votes to knock off Biden and Harris, Pelosi is already long gone.
So you’re saying they will continue to impeach on down the line until they find a Republican in the line of succession? I wouldn’t put it past them, but it’s a pretty damn long list.
No, I don’t think so. But I do like the attempted charge of hypocrisy based on what you would do if you were in their position.
They might certainly do that, if that’s what it takes. But more directly, once they have a majority in the House and Senate (as required to go impeaching anybody), they will have already removed Pelosi from being Speaker of the House.
I’d say that it’s more that, if they manage to impeach Biden, that means that the house is already in Republican hands.
Oh. Right.
After January 3, 2023 Kevin McCarthy (R - CA) will be right behind Harris on that list.
No, but it will stall the process, make it seem as if the Democrats are ineffectual wusses, and probably put them back on top when the next election rolls by.
Unless the Republicans actually do make Trump the Speaker of the House without anybody electing him to anything.
Which is perfectly legal despite 98.372% of this Board that would decry it as the Pubs doing something unconstitutional.
That seems a precise number for absolute nonsense.
Given the fact that Republicans would try to immediately impeach Biden and Harris and install Trump as an unelected president, you can see where our concerns come from.
Didn’t say you shouldn’t be concerned. Just saying it would be claimed to be unconstitutional by many on the SD.
Breyer’s retirement letter:
Paraphrased: I’ll stay on the bench until you have my successor confirmed.
And the GOP rubs its scaly, clawed hands together.
I’ve seen worried posts about the Republicans planning this for months now, but I’m pretty sure I’ve never seen anyone say it would be unconstitutional for them to do. More like, “These fuckers are gonna try to do this, aren’t they?”
