I don’t know that this is a hate crime. It sounds like his motivation was an altercation between the kids, not their orientation. If they weren’t gay, sounds like he still woulda done it. If the kids weren’t fighting, he wouldn’t have.
If any of those are false, then I retract my assertion.
Where did you see this? None of the articles I’ve read mentioned a fight between the kids, but I may have missed it.
CNN just ran an interview here where the women asserted that the man used continual homophobic profanity/slurs against them before, during, and after the battery. But that’s his word against theirs. And about a dozen witnesses, of course.

I don’t think profanity used during an assault can be used to determine motivation for the attack. If I call some guy a puny bitch while stomping him, I’m not biased against tiny people. It’s cuz he groped my girlfriend/slurred my mom/stole my car. Trying to hurt the women’s feelings by mentioning their orientation doesn’t equate beating them because of it.
I’m also reserving judgment because the story is one sided. For all I know, the women got in the guy’s face and threatened him or his kid or something. Sometimes a bitch needs laid out.
I just watched this interview on CTV.ca, and both woman say that there was a minor issue on Friday. Apparently, his son was hitting their son, so they asked the school for help. They did not actually speak to his child at all, as far as I can tell. The man waited until Monday after school to attack them.
Given the garbage he was spewing as he assaulted them, the fact that the two moms never actually interacted with his child, and the fact that there was no real ‘altercation’ between the two children, I still think he should be charged with a hate crime. I suspect he’d been waiting for some time for something he could use as his excuse to attack them, and his son being reprimanded gave him the excuse (in his own mind). He certainly wasn’t acting out of concern for his child.
Right. So even if there was an altercation between the children, I don’t think he attacked the two women because of that. I think he saw it as his opportunity.

I did not intend to say you are. I am saying that, based on the interview I saw, I think it was a hate crime. What you posted further strengthened my opinion, but did not lead me to believe you agreed with said opinion.
Given that I have no legal knowledge, and am basing my statements solely on my opinion, I think I’m going to refrain from posting further in this thread until I have actual facts. I hope someone better versed in the Ontario legal system will drop in. I’d love to know what the actual requirements for a hate crime are, because I’m pretty certain they do not include the gut feelings of some random Calgarian.

I’m kind of surprised this is making news. I guess it’s the hate crime thing. Dyke bashing is hardly rare. Just because so many men enjoy girl-on-girl porn doesn’t mean they take well to real-live lesbians.

Still a hate crime in Canada needs to be based on either inciting genocide or publicly inciting crimes against an identifiable group.

The max for assault causing bodily harm is 10 years. The max for willful promotion of hatred is 2 years. Given the degree of severity of the assault, I doubt if sentences would be consecutive.
The case for assault causing bodily harm is a slam dunk. The case for willful promotion of hatred is doubtful, for the reason set forth by Grey (“This is just someone, who happens to hold bigoted views, beating someone else up”), and because it could be argued that the remarks during the assault were made in a private conversation between the parties.
All in all, this is not the sort of case that should go forward as a hate crime. Better to keep it confined to assault causing bodily harm, and then consider the lesbian hatred as an aggravating factor when sentencing, and when setting parole conditions.
Then, on a community level, keep an eye on him once he is out of the can, and have him prosecuted for anything from breach to willful promotion of hatred if he is stupid enough to open his yap. Hey, in criminal law, there is nothing better than a repeat customer.
Well, while the gut feelings of a random Calgarian are not taken into account on sentencing ;), the law on this issue is the same in Ontario and Alberta, since the criminal law is a federal law, uniform across Canada.
I agree that on the facts given, it doesn’t look like a hate crime per se, but under Canadian law, the motivation for a crime can be an aggravating factor in sentence for any offence. See s. 718.2:
So, if the fellow is convicted of common assault or assault causing, it is possible that the Crown could argue his motivation is an aggravating factor on sentencing.
