Is this the same person who was at risk for getting a life sentence a few months ago? i know a few months ago, it might have been longer, someone growing medical marijuana had been arrested and was at risk for a life sentence. is this the same person or was that a different case.
Same person, Ed Rosenthal. He has been a proponent of pro-legalization for a LONG time. Essentially, he had a grow operation that supported a local medical marijuana co-op.
I am glad this judge did what he did - this should be a state’s rights issue, and California, under Proposition 215, effectively decriminalized medical marijuana. While its true that the fed law superceeds this one, the sentence appears to mitigate this conflict.
Hopefully the feds won’t spend any more money prosecuting people like this. I hope this case sets a solid precedent, and any similar cases reach the same verdict.
I’m glad the judge did it too, it shows a rare glimmer of sense beyond the screaming howl of our federal prosecutors.
