New York State Supreme Court Justice Jack Battaglia's $1,000,000 lawsuit

So I’m reading this article on Cracked.com today about 9 Insane Cases that Prove the US Legal System Is Screwed and there are a couple that were unresolved as of the writing of the article (12 June 2008). This was the only case that I couldn’t seem to find anything online about a possible resolution.

On page two, #5 is about New York State Supreme Court Justice Jack Battaglia, who slipped on a floor that had just been mopped. He filed a lawsuit seeking not just $1 million from the city, but also from sought recompense from the janitor who mopped the floor.

I found a couple of articles about this from 2008, one of which said that there had been a change of venue because of personal ties between Judge Battaglia and the judge who was originally set to hear his case, but I didn’t find anything about whether or not the case had ever been settled.
