I’ve said it before, I’ll say it again - I just don’t get people like this. The greatest anger I’ve ever felt as an adult led me to write a harshly worded open letter to my student government. The last time I threw a punch was in middle school - it did no harm (that was pretty much the first punch I’d thrown in anger, ever), but I still feel bad about it. Beating a man to death, even with help, is not a fast process - that’s why we invented weapons, after all. What has to be going through your mind to convince you that carrying through to the end is a good idea?

Who, conveniently, was 5’ 6" tall and weighed 125 lbs.

Predictably, the four accused are claiming innocence and blaming each other. I hope the witness evidence will be strong enough to determine who was involved and make it stick.

An earlier version of the story said that a local attorney showed up shortly after the incident and was encouraging potential witnesses not to cooperate with the police. What’s Latin for “snitches get stitches”?

Latest word is that a broken rib penetrated his heart, which could have come from a single stomp. Even if not, people have died from one-punch fights. It sometimes is a fast process. More to the point, real humans cannot always endure the amazing violence they routinely survive in films and television. I suspect a lot of killers, lacking both imagination and education, didn’t have any idea whacking someone on the head (or whatever) would flat-out kill them, and were surprised.

I don’t think anyone suggests a lot of thinking occurred. Violent kids went overboard and will pay for the rest of their lives. It is sad.

It’s sad for the victim.

I hope the assailants ride a needle, and that those who stood by and watched it happen are haunted for the rest of their lives for their part in this.

I really hate to turn this into a debate on the death penalty (it’s been done ad nauseum and no arguments are likely to be original or convincing) but don’t death sentences require premeditation as an element of the murder charge in the case? From the “facts” of the story, this has no element of premeditation.

I was wondering about that myself. But since they made a conscious decision to beat the guy up, I’d bet that counts. More lawyerly types will, I’m sure, clear this up.

Dunno. That guy in CT who just got the DP; did he and his partner in crime plan on killing that lady and her daughter beforehand, or just plan to rob them?

When you’re talking felony murder, I think that the intent to commit the felony counts as the intent to commit murder. I believe that if I shoot you in the course of a premeditated armed robbery I’m committing against you, it’s legally identical to me planning to shoot you. The concept is that you’re responsible for the direct consequences of your illegal act.

IANAL but IIRC felony murder is when someone unintentionally dies during the comission of a felony. For example, if someone has a heart attack while you are robbing the bank.

Manslaughter is when someone dies as a direct result of an action that wasn’t intended to kill but had malice aforethought. Like tossing a brick off the overpass. That would be the case in this situation. These four retards probably weren’t trying to kill the kid, but they were committing a dangerous and illegal action that nevertheless resulted in his death.

Sure, but the cretins in the CT case, I believe, had all the family members bound (so as to prevent the disruption of their burglary) and then killed them, seemingly unnecessarily.

But doesn’t the heart attack have to be demonstrably attributed to the bank robbery?

If I remember correctly, there have been at least a couple cases in which premeditation was found on the basis of the handful of seconds that elapsed between the killer’s decision to kill and the killing itself.

Ultimately, the better argument is lack of intent rather than lack of premeditation, though both should, of course, be used by defense counsel.
