renters rights, need advice

i am having a real problem with my neighbors and leasing office. im at my wits end. im not sure what do to. i need some advice. i have the worlds most inconsiderate neighbors on both sides. theyre always blasting their stereos and tvs. ive asked them to stop, ive complained to the leasing office and ive even tried to contact the corporate office in orlando. i signed a new lease a few months. i really cant afford to move, especially after xmas and all. is it possible for me to ask to get out of my lease when i get my refund check? i cant live like this. im only 24 and they make me feel like an old lady, always yelling to turn the radio down and complaining to the management. one of the probelms is, the loud neighbor is pregnant. there are plenty of open apartments here on the complex, im not sure they will move. ive been here longer, am quite, and except for complaining about the nose, keep to myself. what rights do i have? i shouldnt have to live like this!!! help me!!! advice

I have moved from one unit to another twice within the same complex with no penalty. Ask if there is another unit the same as yours available, then you may consider filing noise complaints formally in writing with the management, with the written understanding that if they do not handle it, you will call the police. Management does not like police coming in, it places their complex in the files, which people like me look into before signing.

There is likely a legal aid or Department of Housing unit in your area - contact them and make sure that you have rights. Although this is not true in all states/provionces, a written agreement between landlord and tenant mutually agreeing to break a lease may result in a small fine (my former housemate payed 100$), however it is perfectly legal to do so. You cannot (as far as I know) just stop paying rent/leave without notice.

Contact a lawyer or your Department of Housing. if your neighbours are only loud during the day, then there might not be much you can do - noise restriction laws (if there are any) tend to only apply at night, like after 11pm. Discuss the sitatuon with your landlord/superintendent - if they agree that they are disruptive, then an eviction may be possible.

Good luck!

thins is, i don wanna leave this apartment. it burnt down a year before i moved in so everythings brand new. the other places arent as nice as this. walls are yellow, cabinets are old, carpet is bare. i like my new, pretty apartment. it is not an option for me to move from the place unless im moving to another complex. another question, can i get into trouble with the management about comaplaining too much? can they evict me for that or come up with a lame excuse to get me outta here?

apartments are notorious for paper thin walls. i hear the telephones ringing, doors and cabinets closing, and coughing. i dont a have probelm with these things. only the boom, boom, boom of tvs and stereos. tonight, they were just hanging out in the front of their door, in the hallway, chatting it up with friends. its freezing out, who does that. i could hear every word that was spoken. they just dont care about others in the building and the leasing office doesnt care as long as theyre paying their rent. i guess its gonna have to be brought up to the housing department. maybe they can help me or give me some ideas. i really dont wanna move.

Capitalization helps people around here take your post more seriously, as it is easier to read and lends an air of maturity to what you have to say.

If you don’t have any luck with the building managers, call the police when your neighbors blast their stereo (after asking them politely to turn it down.)

Police will respond to noise complaints, and it’s likely to make an impression upon said bastard neighbor.

ear plugs…

You didn’t say where you are but there are Tenants Rights handbooks at your library, bookstore or police station or nolo.com (nolo press)…

If you have asked them to turn it down and they don’t, they next step is to ask your apartment manager to speak with them. If they do not do so, or it has no effect, call the police. You may need to do that several times before they actually stop, but no one likes the cops showing up unannounced at the door. Come to think of it, I should do the same thing. The mexicans that live on all sides of me blast the music pretty much every day, and the residents go about their business as if this were perfectly normal. Few things bug me as much as that kind of inconsiderate behavior.

Noisy neighbors–I’ve had my share, and have had good and bad luck getting them to quiet down. Some apartment managers will act quickly and solve the problem, others just don’t want to be bothered. The leases I’ve signed have a clause that states that you are entitled to the “quiet enjoyment” of your residence. To me, that means that you should be able to sit on your sofa and read without having to listen to someone else’s stereo, or whatever. If your neighbors are jerks, or just live noisy lives, you may be out of luck…

When a guy in an apt learned that I was deaf he would turn his stereo up so high the floors vibrated. So I went to his apt & banged & banged on his door (Im surprised he could hear that) & he turned it down. I had to do this each time.

and i would do that if my right arm wasnt in a sling and i was able to use my left hand like a normal person. jeez, i forgot about the grammar nazis here. i appreciate all your advice. corporate called me back today. both are sitting with 2 legal warnings, 1 more and they will be evicted. guess i made such a stink and so much noise, the management was afraid id do something silly like sue. thank you all again

Yikes, that would make it hard. I am glad the management looks like they are handling it. I wish you peace and quiet very soon!

…and uncle bill (who offered some friendly free advice in a post above his recent recommendation) is a nazi because he mentioned the fact that your posts are practically incoherent because of your slipshod typing style? you seem to get the periods and the commas and the and the exclamation points and the spelling okay, but the parentheses and apostrophe and shift keys are outside the reach of your right hand? bollocks.

exactly. i would need two hands to press the letter and the shift key. im literally pecking the letters. i could type in all caps but then someone would think i was shouting. three mores days and i will be a regular old typist again. as for the exclamation point, easily reached with my uncoperative left hand.

FWIW, I didn’t think she was calling me a grammar nazi, andmrs bales, if you WERE, just don’t tell me, and leave me to my blissful ignorance.

I had neighbors so inconsiderate that they would park their car right in front of the building, open up all the doors, and blast rap music as loud as it would go. Then they’d just stand there and listen to it.

One of my other neighbors called the police. They didn’t get the message. Then a second neighbor called the landlord, who, in turn, called the police a second time. Since then, I haven’t heard a peep. I just love cops sometimes.

Of course, this is much more effective if the noisy neighbors are drug dealers, which I suspect mine are.

That is one of the most graceful responces I have witnessed in a very long time. Well done.

And, as much as I don’t want to bump this thread to apologise, I shall:

My examples were all right-handed two-fingered characters EXCEPT for the exclamation points. I realized it in an epiphany moment of clarity earlier today and came back to this thread, to find my recent bitching nullified.

UncleBill, I owe you an apology too - you certainly don’t need me to answer for you.

mrs bales, welcome to the boards and please accept my apology.

At the risk of telling you something you may already know…

… for Win O/Ss, the Accessibility Options control panel has a switch called Sticky Keys that allows one-handed shift, (and I think) control and alt key combos. With this feature on, hit the shift, and the next letter you type will be capitalized.

As to the OP, nothing to add. Sorry.
