This is kind of an update of several threads dealing with my ex-wife. For the purposes of clarity and briefness, I’ll just list the pertinent facts here rather than linking multiple threads. So in brief:
Before my boys moved in with me I paid child support for two years. During that period unbeknownst to me, my ex was also receiving welfare (illegal as it turned out as she didn’t report that I had been paying child support). After getting arrested on an unrelated drug charge they came to live with me, and a fight for custody ensued. I’ve had wage garnishments started, dismissed, reinstated, dismissed, reinstated, dismissed, reinstated and tax refunds withheld. No I wasn’t repeating myself in that last sentence, well I was but it was for a good reason. Since 1999, with a couple hiatus’ my Ex has been collecting welfare for the boys who have been living with me also since 1999.
All this came to a head last week when I received a subpoena. Since then I have been interviewed by a couple of different investigators. So have the boys unfortunately. Today was the hearing of evidence in the investigation. It was pretty simple, they asked me to confirm a statement, asked me some other questions. A couple of investigators turned in reports. Then we pretty much sat around and waited till 3 for the ex to show. She never did, the Ex was a no show. As it turned out this was an administrative fraud investigation, it was nothing like a real courtroom although I had to be sworn. The judge recommended prosecution.
So you’re probably wondering what I meant about the getting paid part. Well it seems I’ve been a witness on behalf of the government, so I get $35 plu mileage for showing up and talking for 10 minutes. I think I’ll take the kids out for ice cream or something with it.
Sounds like you’ve been thorugh hell with the ex. I sincerely hope she gets what she deserves in accordance with the laws she has broken, and that you’re able to help the kids move past it. Ice cream (quality time) with them is an excellent way to start!
My ex was nabbed for welfare fraud and was ordered to pay back the state about $10,000. She decided to go live in Colorado and hide out instead. Some government beauracrat decided to keep all the child support I was paying at the time and applying to the amount owed even though the fraud did not involved my son in any way. That same beauracrat decided that because my son was almost 18 and my obligation to pay support would end decided to arbitrarily triple the amount of support I paid. No letter, no hearing, my paycheck was garnished without the approval of any court. I got a restraining order a week later to stop the garnishment and was given a hearing date. The government beauracrat told the judge at the hearing she could do what ever she wanted to collect the money even though I did not owe it and there was nothing he could do. The judge immediately found the bitch in contempt, ordered my support returned to it’s previous level and was given a refund of all the money garnished. The judge also order the beauracrats supervisor to review all the woman’s cases and was to give him a complete review in 90 days.
Dealing with this and my half a dozen court visits peaked my interest in legal issues and I have since become a licensed paralegal. I’m 4-0 in small claims cases and recently successfully handled my first bankruptcy case.
Damn racer that’s really shitty, but I feel a kinship. My ex owes something like $30,000 (I have the exact figure around here somewhere). Nobody has given me a single clue as to how I might go about getting my money back.
