Laws have been put in place to prevent others from doing all sorts of things that used to be legal, and we don’t now advocate scrapping those laws just because someone’s ancestor did it when it was legal; it used to be legal to discriminate against women, to own slaves, to do any number of things — and the fact that someone’s ancestors legally did that stuff then doesn’t mean we should let other people do it now; it’s simply and only irrelevant.
