People are suggesting that Republicans will let this one go by without a fight since they can’t win. Why should they do that? If McConnell could pull out some arcane rule or shady witness to stop her from getting the seat, he would in a heartbeat no matter the votes.
Right. If they thought they could win the fight, they would certainly engage in it. But if they don’t think they can win the fight, why waste the energy?

There are additional steps they could take if they were willing to go to the extreme. The Senate needs 51 Senators to establish a quorum, so if they boycott the session they could bring the Senate to a halt.

Perhaps more to the point, it was a stupid error by Biden to say he was going to nominate a Black woman. This meant Brown Jackson would inevitably be painted by some on the right as an affirmative action pick, no matter her qualifications. Had he simple nominated her, it would have just been him nominating a skilled jurist who was, as it happens, a Black woman.
I believe that if Biden wanted to nominate a Black woman for the job for reasons of representation, that is a legitimate criteria. SAYING it, though, simply gave trolls ammunition.
They would have done that anyway. Biden did that during the primary to help his campaign – and IMO it was a good political decision. It made me like him better (though I supported Bernie at the time). The trolls can be ignored or directly refuted, but they shouldn’t be catered to.
I very much agree with this. I like that a public defender will be on the Court to give that type of perspective. But her race isn’t a part of that perspective. And again, I delight, like most decent Americans, that we are reaching this step. But I viscerally do not like using race and gender as benchmarks. They are divisive and will have to continue to be so for hundreds of years (first lesbian transgender Asian-American disabled person) and there should be a shorter healing plan than that.
Perhaps race and sex shouldn’t deeply affect our perspective of the world, but they do. So i think that’s an important aspect of “perspective”.
Does it? Does a black woman that graduates from Harvard and is a federal judge give a typical perspective of black women such that race and gender are adequately represented?
And it doesn’t work the other way as well. Privileged guys like Kavanaugh don’t represent my male whiteness. I think we put too much on those labels.
It’s better than not having her on the Court. I’m certain she has experiences as a Black woman in America that haven’t been seen on the Court before.

In context, not really. I mean maybe, arguably. But like King John of England marrying Isabella of Angoulême it was a calculated step that made sense at the time. It may well have saved Biden’s nomination in the primary and Biden being nominated may well have saved the election for the Democrats in the election given Trump’s shocking level of undead strength among the electorate.
It’s all speculative, but as a bit of political theater it may have been worth the hit.
If Joe Biden doesn’t pledge to nominate a black woman to the Supreme Court, someone else is President right now, most likely Trump.
It was the best political move that Biden made in his career.
