As always, it’s activist judges when you lose and strict constructionists when you win. Someday we’ll ditch the pretense that the court is any less political than the other branches. The Court even has “third way” justices in Roberts and Kennedy.

The basis is in the 14th Amendment…and it strengthens the 10th, by affirming a right reserved to the people. It also strengthens the 1st, a little, by rejecting a notion that was almost purely religious in nature.

This is just Republican talking points, and not a factual assertion about the law. The Supreme Court interprets the Constitution, and like it or not, many intelligent and educated lawyers and judges interpret it differently.
Which is pretty much the reason for SCOTUS to exist.

I’ve always considered “legislating from the bench” to be making up new laws. To me the best example is granting standing to people who challenge things like Ten Commandments displays. It makes no sense that a taxpayer can’t challenge spending but anyone can decide that a religious display does them substantial harm.
There is nothing in the Constitution that gives us the right to challenge spending.
There is something in the Constitution about the state establishing a religion.
It makes plenty of sense.
Which has nothing to do with the issue of standing. Lots of things are unconstitutional or illegal, but not just anyone can sue to stop it. Except, it seems, religious symbols.
If religious organizations can decide arbitrarily what they find offensive, the rest of us surely should be able to get redress by being offended by those symbols.
