Does it count as felony murder if one of them got killed by the FBI during a felony? I didn’t think it worked that way, only if one of them killed someone.

So it sounds like maybe they were waiting for the right situation, which turned out to be 7 or 8 of them in one or several cars that could be surrounded and captured with the advantage belonging totally to the authorities.
Maybe waiting them out and treating it like a big joke caused them to become overconfident (it does seem like a stupid move to be traveling all together like that). Maybe while we were all (myself included) quarterbacking the feds knew exactly what they were doing.
If you rob a bank and that old guy over by the deposit slips counter has a stroke there and dies four days later, it is possible that you could be charged with murder, even if you never even noticed that that guy was standing there.
Exactly. Note the Texas case where the getaway driver, who wasn’t even in the bank, was executed for murder. One of his buddies actually pulled the trigger, but the driver, because he was part of the gang, was also guilty of murder.
This applies equally if a bank guard had killed one of the bank robbers. The driver, waiting outside, is still liable to a charge of murder, because “someone died” during a crime he was engaged in committing.

They are saying Pete Santilli was arrested and faces the same charges as the rest. I don’t know, his youtube channel is streaming live video. It’s nothing interesting, just a shot of a hotel and someone taking occasional calls in the background.
I hope the feds have video of the shooting. In the background of the Santilli stream I heard a woman say “Yeah, he has his hands up and they just shot him.” Of course there’s no possible way anyone would know that, but it’s sure to be the new rallying cry.
