Kinthalis, I’m amazed at how dismissive you are of emotional pain. Do you think that it’s not “real” pain? I’ve had both physical pain and emotional pain that made me wish for my own death. I knew that the physical pain would get better every day. That made it bearable. The intense emotional pain lasted for less than twenty-four hours and I wasn’t rational. After I was put to sleep for the next twenty-four hours, I could function.
You really aren’t in a position to judge the pain someone else feels even by a symbolic act.
If a body once housed the spirit of someone who was greatly loved, the chances are that someone is going to have feelings about the remains. It will never just be a “slab of meat” anymore than it was when it was living. That’s why bodies are cremated and the ashes strewn in a garden rather than flushed down a toilet.
If it doesn’t matter to you, you are an exception and that’s fine. Just don’t project your needs onto society as a whole. Most cultures have developed death rituals independently and for good reason.

I’m not being dismissive. I just don’t think emotional pain, no matter how large deserves a decade in jail. How on earth could you possibly think it does?
Emotional pain is by definition relative and arbitrary. Some people feel emotional pain because you don’t wish them a merry Christmas.
Can you name some other law that requires one to spend a decade in jail for inflicting emotional pain on someone? I can certainly see a lawsuit stemming from this kind of incident, but a decade in jail for hurting granny’s feelings?

Seven years in jail is way too much. Any further jail time is too much, given that he’s been in jail since last October, has been identified as a necropheliac (sp?) and is barred from working in hospitals and morgues, I assume for life.
But I think it’s easy to miss the point here. Sure, once you’re dead you can’t give or deny consent, so whether the 92 year old woman was ‘hurt’ or ‘defiled’ isn’t the issue. Her family were very hurt though, and this is bound to affect their memories of her even to a small extent. That’s the reason what this guy did was wrong.
It’s a mental health rather than a criminal issue though, and he shouldn’t be in jail, certainly not for as long as seven years when as other posters have pointed out many people get less than this for actual rape. But let’s not say ‘no-one was hurt’ because the person he chose to stick his dick into was dead. I’d be very upset if that happened to my mum (myself, not so much*), and I think that’s a pretty normal reaction.
*Yes, yes, I know I’m dead, but I mean if I knew now someone would do that to me after death, y’pedants.

So what other crimes do you feel should be punished based strictly on how upset the victim’s family is? Like I said earlier, if someone damaged my property I’d probably want to hurt them, badly. That’s why we have a legal system that determines punishments dispassionately, rather than the vigilante justice for the victim or their family to get even, which you all seem to want.
