I for one was disappointed that we didn’t get to see Michael majorly screwing up, mispronouncing, or misusing a fancy legal term, a la “philanderer” instead of “philantrhopist.”

I’m a little late to this conversion, but wasn’t Jan merely fired for incompetence? I remember an episode saying that she went a little crazy after her divorce. She said she was in therapy.

I thought low self-esteem issues were why she got a boob job and started dating Michael, but they had nothing to do with her termination.

Probably not “incompetence” as such, but probably nonfeasance and misfeasance (probably not malfeasance, though). Not knowing whether Jan had an employment contract, or if so what was in it, it’s hard to say whether they would have fired her officially for cause or not given any cause at all. Either way, Jan can try to prove that the cause/non-cause was not the real reason, but it was for some “wrongful” reason (specifically gender discrimination).

My impression was that she has been in therapy for a long time. She isn’t in contact with the rest of her family (on advice of counsel).

That’s what will be at issue in the litigation. The company will say it was because she performed poorly and Jan will say it was because of discrimination.

Anyway, so far as I know, it’s not “wrongful” in a legal sense to fire someone for having low self esteem, or even for getting breast enhancements (unless it can be shown that this constitutes gender discrimination).

David (the big guy) said she was spending all her time shopping online and leaving for long periods of time then saying that she was visiting her sister in Arizona.

Another odd thing – David is the nominally the chief financial officer, but he seems to have more general authority over things like hiring for Jan/Ryan’s position.
