Will mudgirl have to testify in some way, or are they just using her previous statement? She’s so young… I’m assuming that if she does, you’ll have to be careful prepping her. I have no idea how I would do it.

Her name does not appear on the subpoena, and she’s received none of her own. Nonetheless, I just left a voice mail for the ADA who’s handling the case to make sure that she won’t have to appear. If she will have to appear, we’ll work with her ahead of time to minimize trauma.

As it is, I’ve requested my hubby put in for that day off work so he can come with me, because I think it may be somewhat traumatic for me. But I’ll get through it, and hopefully justice will be served.

I’m a bit confused…you were served papers? I’m assuming this is a notice the trial/arraignment/plea is going forward?

Yes, I’m considered a ‘witness’, even though I didn’t actually see anything. I’m assuming it’s because I’m her mother, I’m the first person she told, and I’m the one who called the police.

At least around here, if you want to subpoena a minor child to come to court as a witness, you HAVE to subpoena the parent and have them attend with the child. Usually the subpoena will mention bringing the child, though.

Yes, I’m certain laws around here would require attendance of a parent or guardian with the child, as well. But in this case, she is not mentioned at all in the subpoena.

I have called the ADA who is listed on the papers and left a voice-mail asking for clarification on whether mudgirl needs to come with me or not. If not, I think I’ll wait until closer to the court date to talk to her about it. A week can seem like an awfully long time when you’re 8, and she’s doing well, and I’d hate to have her worrying about this for a whole week.

I just had to chime in with my thoughts and wishes headed your way, and for a positive outcome on all of this. (I am glad I am able to post these now, too.)
