The gist seems to be that with National Emergencies Act of 1976 Congress basically ceded a lot of its power to the Executive branch. There is apparently no standard for what is meant by ‘emergency’ other than ‘the President says so’. And apparently he can veto Congress’s resolution saying ‘is not’ - so what can be done?
Oh, and the author also thinks that the courts will be loathe to save Congress from itself, which is probably also true.
There’s probably a rule against cross-posting or self-promotion or whatever; but I launched a thread on GD today precisely on the subject of the Emergencies Act and what we can do about it.

That bit of dialogue is from my favorite episode of Andy Griffith, “Man in a Hurry.” A big city businessman is passing through Mayberry on a Sunday, and his car breaks down. He’s has no choice but to sit there all day cooling his heels while Andy and the gang go slowly about the Lord’s Day’s business, which is to say not much of anything. At first the stranger bristles and chafes at the leisurely pace, but by the end of the show he yields to Mayberry’s spell and after Aunt Bee’s Sunday sinner, he sits on Andy’s front porch peeling an apple in one strip while Andy strums his guitar and sings, “Little Old Church in the Vale.” Eventually the stranger dozes off. I adore that episode. Thank you for reminding me of it.
The whole episode is well worth watching. Especially on a Sunday.

He can veto Congress’s resolution if the Republicans support him in his fake national emergency/power-grab/overreach that they’d condemn if a Democrat did it; to be veto proof, a 2/3 vote is required.
Looked at another way: If enough Republicans set aside their servile sycophancy for one vote, Trump would be helpless.
We’ll watch Andy until we make ourselves sick from eating cashew fudge.

Really large speed bump: Yertle. They cannot even vote on it in the Senate unless he lets them. He kind of has veto power right in his wattle.

Apparently not in this case; this resolution has special powers that require a vote.

President Trump took to Twitter on Sunday to apparently circulate a call for the jailing of those who investigate him, including Special Counsel Robert Mueller. “‘These guys, the investigators, ought to be in jail. What they have done, working with the Obama intelligence agencies, is simply unprecedented,’” Trump wrote, quoting conservative pundit Rush Limbaugh. “‘This is one of the greatest political hoaxes ever perpetrated on the people of this Country, and Mueller is a coverup.’” He later added, in his own words, that “The Mueller investigation is totally conflicted, illegal and rigged! Should never have been allowed to begin, except for the Collusion and many crimes committed by the Democrats. Witch Hunt!”
The president’s tweets came hours after House Intelligence chairman Adam Schiff (D-CA) said Sunday that there’s “evidence in plain sight” that Trump colluded with Russia. “All of this is evidence of collusion, and you either have to look the other way to say it isn’t or you have to have a different word for it, because it is a corrupt dealing with a foreign adversary during a campaign,” Schiff told CNN’s Dana Bash.

It’s not a great excuse, but there was an assumption of norms of governance back then - which Trump and the GOP in general have blown through without looking back.
