This is what a lot of people don’t realize, mainly because it’s not being covered in the media. But Moscow Mitch is changing the federal court system in ways that will be felt for decades. Of all the things that angers me about people who voted against or simply refused to vote at all for Hillary Clinton, this is what embitters me the most. This idea that “We can get a better candidate 4 years from now” – No. No, you can’t. No Democratic candidate in the race now will be able to reverse this damage. And probably no Democratic candidate over the next one or two decades will be able to either.

Yeah, that was the first thought that crossed my mind when I read that sentence.

Specifically, the U.S. Court of Appeals for the Eighth Circuit (post 35162 from dasmoocher), the ABA, Federal Courts, State courts, law scholars, etc. Do you have to write emails at your job? Can you write one that sounds as stupid as a Trump conspirator and expect to keep your job? Can it have any misspellings? Of course not. Neither can I.

This dope would have affidavits that were incomplete and would say things like, “Der… they’re all criminals! Send them back where they came from!”

ETA: I’ll be really clear here: AFAIK there is no legal requirement for a judge to write or say anything other than “guilty” “not guilty” and/or “I rule in favor of ———.” Nothing compels them to write any explanation of their reasoning or the history of the law that they followed or anything else.

Thanks for answering my question tho: “It’s what is expected” is the same as “there’s no requirement”. How has the country been doing lately by relying on what is expected? How did Merrick Garland’s SCOTUS nomination go? How did the 2016 election go? How has the effort to deny security clearances to questionable people gone? How has it been forging compromise in Congress lately?

No judge will have to write shit. And the justices above them won’t have to write anything. All the way up to the TrumpConnell-packed SCOTUS, which will simply say “nothing to see here; move along”. Because there are no controls, no punishments, no requirements which can be enforced. Relying on tradition or custom requires everyone to be in on the game and the GOP is not interested in playing that game anymore.

To be fair, do you really think it’ll be all that easy to find someone dumber than Trump’s nominees for the position?
