Elon Musk traveled to China with President Donald Trump this week, despite his ongoing trial over his lawsuit with OpenAI and a federal judge’s order that he remain at the ready to be recalled to testify at short notice.
The trial is for a lawsuit that Musk filed against artificial intelligence startup OpenAI. Musk, a co-founder of OpenAI, alleges that the company has betrayed its original nonprofit mission by creating a for-profit arm. He testified in the trial in Oakland, California, over three days last month.
Before Musk left the witness stand April 30, U.S. District Judge Yvonne Gonzalez Rogers asked the parties if there was any reason to hold Musk in “recall status,” meaning that he should be available to testify again if called upon to do so. OpenAI lawyers said, “Yes.” The judge instructed him: “OK, Mr. Musk, you are not excused, but you can leave for the day.”
But Musk is now in China with Trump on a state visit .
Two sources familiar with the matter told NBC News that Musk didn’t obtain permission from the judge before leaving the country and was still subject to recall as a witness.

A new federal lawsuit accuses Secretary of Agriculture Brooke Rollins of proselytizing federal employees by frequently invoking Jesus Christ in work emails.
The National Federation of Federal Employees and a group of seven USDA employees filed the lawsuit in California, accusing Rollins of violating the Establishment Clause of the First Amendment.
“Secretary Rollins’s practice and policy of subjecting agency employees to proselytizing messages conveys the expectation that USDA employees share in the Secretary’s religious beliefs, even when doing so would betray an employee’s own beliefs,” the lawsuit said. “It is exactly the sort of government-sponsored religious coercion, religious sermonizing, and denominational preference that the Establishment Clause prohibits.”
The complaint listed a series of emails sent by Rollins to commemorate recent holidays, including crediting “gratitude towards a loving God” in her Thanksgiving email, writing that “God gave us the greatest gift possible” in her Christmas email, and describing the story of Jesus’ resurrection as the “greatest story ever told” in her Easter email. Rollins only acknowledged Christian holidays, according to the complaint.

Rep. Jamie Raskin (D-Md.) notified acting Attorney General Todd Blanche on Tuesday that as part of a House Judiciary Committee investigation of institutional fraud and abuse, he is now digging into millions of dollars allegedly paid out to FBI agents who had been suspended, fired or had their security clearances revoked, including at least one agent who was in a restricted area at the Capitol on Jan. 6, 2021.
In a letter thoroughly detailing the allegations, Raskin claims the committee has learned from multiple sources that the DOJ ordered the FBI to shell out “massive settlements to nearly a dozen FBI employees who were disciplined and suspended for gross violations of FBI policy and federal law.”
The agent who was at the Capitol received a settlement of $63,500 plus backpay to the tune of hundreds of thousands of dollars, even though he was not eligible for it.
Another agent flagged by Raskin allegedly refused to investigate the white nationalist group Patriot Front, had his security clearance revoked and was then fired. The agent “later admitted to accepting commercial *** while on an official assignment overseas,” Raskin wrote Tuesday, but was “amazingly” reinstated once Kash Patel became director. Raskin says this agent was paid “several hundred thousand dollars.”

The president was pressed on whether he’d try to send federal resources to intimidate voters as he departed the White House for a state visit to China. Asked whether he’d send National Guard or ICE to voting locations, Trump replied: “I do anything necessary to make sure we have honest elections.”

An Alabama construction worker who is suing the Department of Homeland Security (DHS) after he was arrested twice last year, despite being a U.S. citizen, was shackled and detained by federal immigration officers for a third time earlier this month, according to court documents.
In a declaration filed in federal court, Leo Garcia Venegas said he was parking in front of his house in Silverhill, Alabama, on the morning of May 2 when an unmarked SUV blocked him in. Venegas claimed that before he could hand his Alabama-issued REAL ID to the two federal Immigration and Customs Enforcement (ICE) officers who approached him, they pulled him out of the truck he was driving and handcuffed him.
What makes the incident extraordinary is that Venegas is the lead plaintiff in a class-action lawsuit challenging DHS’ immigration enforcement policies , and it was the third time he’s been handcuffed and detained by ICE agents. Venegas was detained twice in 2025 during raids on private construction sites where he was working, even though he had a REAL ID identifying him as a U.S. citizen.
The Institute for Justice, a libertarian-leaning public-interest law firm, filed a class-action lawsuit last October on behalf of Venegas and other construction workers seeking to stop “dragnet raids” that target Latinos without any probable cause besides their ethnicity. Venegas and the Institute for Justice argue that DHS policies allow immigration agents to illegally raid private construction sites, detain workers without reasonable suspicion, and continue detaining them even after they offer evidence of citizenship or legal status.
Jared McClain, an Institute for Justice attorney, says that Venegas’ third detention “shows that federal officers are enforcing immigration laws in the unconstitutional way we alleged in our lawsuit.”
“It’s arrest first, ask questions later,” McClain continues. “These aren’t the brief investigatory stops based on individualized suspicion that the Supreme Court has allowed.”

Chinese security officials allegedly blocked an armed U.S. Secret Service agent from entering an event on Thursday during President Donald Trump’s visit to the country, according to media members on the ground.
A Secret Service agent was reportedly blocked from entering Trump and Chinese President Xi Jinping’s visit to Beijing’s Temple of Heaven with their weapon on Thursday, according to reporters. The incident triggered an alleged “intense standoff ” that delayed entry to the venue for over a half-hour due to heated discussions.
“We’ve seen several intense confrontations since being here,” wrote a Telegraph correspondent on X of the situation.

The Washington Examiner spoke with six current and former Border Patrol employees who said Banks traveled to Colombia and Thailand to solicit *** workers there.
“I don’t know how he became the chief of the Border Patrol with his character,” one agent told the outlet on condition of anonymity. “He’s going to third-world countries to take advantage of poor ******* women, which disgusts the hell out of me.”

In fact, President Xi congratulated me on so many tremendous successes in such a short period of time.
Two years ago, we were, in fact, a Nation in decline. On that, I fully agree with President Xi! But now, the United States is the hottest Nation anywhere in the world, and hopefully our relationship with China will be stronger and better than ever before!
