Trump’s statement says, “The seven countries named in the Executive Order are the same countries previously identified by the Obama administration as sources of terror.” Is it so?
Answer: only kinda sorta, at best. Team Trump had to look past a bunch of lists from the Obama years that made more sense before digging up one that they were happy with.
Yes it’s wrong imo as well… someone may require medical visa for advanced treatments, someone else may be a valuable worthy professional having nothing to do with extremism…
This decision seems unreasonable… not as unreasonable and primitive as Islam, but still unreasonable.
I’m having trouble keeping up with the status of those detainees. Is anyone still being held in detention, or have they all been released? Are folks now being turned away at their country of origin, or are we sill having to detain folks in the US who were already traveling when the executive order was issued?
And correct me if I’m wrong here… The EO has two key parts:
No more refugees from the 7 countries. That is, folks coming here for the purpose of resettlement.
Increased scrutiny for folks with passports from those 7 countries. That is, folks can still travel here, but not as refugees and they will be subject to heighten security.
2a. Heightened security can apply to Green Card holders as well.
The Federal judges whose court orders haven’t been complied with can hold the appropriate Federal officials in contempt of court.
When lesser beings like you and me are found in contempt of court, and we’re not physically present in the courtroom, U.S. marshals get sent to our homes and places of work, and we get brought into court, and the judge tells us how long we’re gonna be in the pokey on account of being found in contempt of court.
With more exalted creatures such as Cabinet officials like Mr. Kelly, the secretary of DHS, it can be more of a challenge to get the U.S. marshals to bring them in.
When even conservatives (not the majority, but very influential ones) are complaining about this and the National Review had to still say that the part about the green card was madness and should be condemned. I think that then it is clear who are the ones who are taking the side of the “moran” in chief.
No. Federal law enforcement are effectively immune from arrest by state officials, and no branch of the federal government may direct state law enforcement personnel anyway.
A federal judge can - at least theoretically - direct U.S. Marshals to arrest other federal officials. I highly doubt you’ll see that happen.
I can see that, so we should go for what even Bannon (his main henchman) has called his/their movement: that it is closer to Lenin. Particularly about the part about tearing a country apart under the guise of putting up a new system.

Of course, the opponents will overreact …it’s a wrong decision…it’s not a disastrous decision…I have said before, many of Trump opponents come across as repulsive due to their ego, anger etc. They make neutral people support Trump. He will win in 2020 as well if these repulsive opponents don’t improve.

I’m not sure either. The way the order was created and executed without much consultation or notice to anyone and the way it keeps changing on the whim of the president (yes, it includes green card holders … wait, no it doesn’t … wait again … it might) has created a mess that is very difficult to sort through. Some of the detainees were eventually let in, some were sent back, some aren’t allowed on, and some may still be in detention.
I think the text of the executive order stops a refugee admittance program for all countries, bans Syrian refugees until Donald decides differently, and limits the entry of other refugees.
I think that “I hereby proclaim the immigrant and non-immigrant into the United States of aliens from countries … [referred to another statute, but I think is the 7] … would be detrimental to the interests of the United States, and I suspend entry into the US, as immigrants and nonimmigrants, of such persons for 90 days” means that unless a person from those 7 countries meets the exceptions (diplomats, united nations, certain kinds of visas), they aren’t allowed in.
But I’ve never practiced immigration law, and it’s still kind of a mess legally, especially on a case by case basis, so take it worth a grain of salt.
