Now, does anyone contend that the public disclosure of a registered sex offender’s name and address is, by itself, a misdemeanor or felony pursuant to California law? If so, please specify the precise misdemeanor or felony that you believe qualifies. If not, please refrain from further unfounded suggestion that any actual laws were broken by disclosing such information.

Dude … you’re not helping at all. By and large, this thread is staying civil, which in turns keeps this thread alive. IMHO, it’s in the interest of the board to keep an avenue for discussion of this issue open. You are jeopardizing that with personal attacks.

Don’t get frustrated that minds aren’t changing here. That’s not going to happen, and that’s not the point of this thread anyway. Much understanding is being fostered here (to me, at least). Let’s not destroy this thread.

Looks like Tuba’s posting of his SOR violated LJ policy:

If a user is posting journal entries that make reference to you in a negative fashion, first ask yourself whether a casual viewer of that journal would have enough information available to identify you. In order to be considered abuse, content must identify you in such a way that a random reader could identify a specific person in the physical world.

Generally, this means that the poster must include your full name, your address, your telephone number, or other uniquely identifying material or information. First names, Internet nicknames, LiveJournal usernames, and other forms of non-identifying information do not count as violations of the Terms of Service.

If the material in question does contain a way of uniquely identifying you, you can file a report with the Abuse Team. Be sure to include links to all pertinent entries in the user’s journal. The Abuse Team will not investigate these cases unless reports contain specific links to investigate.

So, since it had his full name, address and picture, that would indeed count as a violation.

I think the quote people are referring to is from the Megan’s Law website itself, namely:

“The information on this web site is made available solely to protect the public. Anyone who uses this information to commit a crime or to harass an offender or his or her family is subject to criminal prosecution and civil liability.”

(bolding mine).

And from the FAQ:
“I want to share with others the information I found on the Attorney General’s Megan’s Law Website. Does the law prohibit me in any way from sharing this information?
A person may use the information disclosed on the Attorney General’s Web site only to protect a person at risk. It is a crime to use the information disclosed on the Attorney General’s Internet Web site to commit a misdemeanor or felony. Unless the information is used to protect a person at risk, it is also prohibited to use any information that is disclosed pursuant to this Internet Web site for a purpose relating to health insurance, insurance, loans, credit, employment, education, scholarships, fellowships, housing, accommodations, or benefits, privileges, or services provided by any business. Misuse of the information may make the user liable for money damages or an injunction against the misuse. Before using the information disclosed on this Web site, you may want to consult with an attorney or merely suggest to others that they view the Web site for themselves.”

I’m sure you, a trained lawyer, can figure out if what Tuba did was “misuse” or not in a legal sense, but I’m sure that I can’t. I haven’t heard anybody say that Tuba consulted with an attorney before disclosing the information, however.
