We already have rape laws; you’re not allowed to have sex with someone who’s not consenting and/or incapable of reasonably giving their consent. I don’t see why we need additional and frequently ludicrous legislation.

OK, I’m working for the summer for a catering company that has a number of openly gay employees. Tonight, one of them was telling us about Fire Island, which is apparently a very exclusive resort island near Long Island where rich queens (his words) own multi-million dollar summer homes. There is a difference between consent and informed consent. A 12 year is capable of giving capable of giving consent, but may not necessarily be capable of giving informed consent. In other words, he doesn’t necessarily have the maturity and experience to under stand the change sex will have on his life nor the potential consequences (both physically and emotionally).
There are adults who take advantage of a youth’s inexperience for sexual reasons, with no regard for the potential effects on the child. The age of consent laws are there to curtail the abuse of children. Take them away and what do you have? A twelve year old who says yes, but regrets it later? A guy who is free to do it to another kid?
I realize that you feel like you were ready for sex at 12. I know for a fact that I wasn’t. My first sexual offer came from my best friend, three years my senior, when I was 12. It took nearly an hour for me to make my decision. I wasn’t even sure what sex was. In my mind, it was just two adults rolling around on sheets and getting sweaty. Had no clue about contraceptives which may have resulted in disaster since I had develops the mechanics of fertility by that age.
I came very close to saying yes. If he had been an adult whom I respected instead of the gawky boy who like to give me noogies, I may have actually given consent.

beakerxf, everyone I’ve chatted with who, as a teenager, had had a sexual experience with an adult partner, said that the experience had a positive, rather than negative, effect on him/her. Opponents of teenage sex with adults frequently talk about the negative emotional consequences to the teenager, but I’ve never seen these negative cases nor any studies done of them.
Also, legally speaking, uninformed consent is the same as no consent at all. And I think we should base statutory rape cases on whether the person actually did informedly consent, not whether or not they were young enough for us to assume that they couldn’t have.

About the age of consent:
I do agree that the ages should be the same for gays and straights. As for the age itself, well…
It’s definitely a grey area, and a complex issue. People mature sexually at different rates. Nobody seriously believes that the ability to give informed consent is magically granted you on your eighteenth birthday, but this is the treatment given the subject by the law, in this state at least. Actually, the law in this state the last time I checked was that nobody can have sex with a child under the age of eighteen, unless the age difference is less than three years. I, for one, think this is a pretty good system. There are always going to be young kids who are ready for sex far earlier, though. I personally know of one girl who seduced a twelve year old boy when she was nine years old. Later, at the age of thirteen, she and another thirteen year old girl seduced a twenty-three year old man. This second girl went on to have a long-term affair with a married man in his thirties, whom she used as a sugar daddy. Then there was my first girlfriend, an extremely agressive fifteen year old (I was eighteen). These are exceptions, though, and not the rule.
Me, I was definitely not ready at age twelve. Sixteen, perhaps, but not twelve. On the other hand, I was fully aware that I could “Just Say No” if the situation arose, but I have no idea how I would have responded to pressure. However, that was never an issue for me, for which I am grateful. I think that if the age of consent is to be lowered, it should be lowered to sixteen, fifteen at the very lowest. If you’re at these ages, and don’t want to have sex, you know how to say no. If you do want to have sex, you’re probably doing it already.
Other than the law, I don’t think there’s really much difference between the sexual maturity of a sixteen and eighteen year old. However, if we view the law in terms of protection, we’re protecting a lot of people in this age group who don’t need it, but we are also protecting a few who do. The assumption is that at eighteen, you know how to take care of yourself, and if you don’t, tough shit. There are laws against raping adults, but no laws against coercing, seducing, or persuading them to do something they wouldn’t otherwise. Do we want to extend that assumption to lower ages, even only two or three years lower? As I said, there are a lot of sixteen year olds who can speak for themselves. There are also a number who probably shouldn’t be made to, much greater than the number of eighteen year olds who shouldn’t. So, all in all, I think the age of consent should stay right where it is, taking into account the hormonal rages of late adolescence as the “three year difference” clause does. So, if you’re eighteen, go do whatever and whoever you want. If you’re sixteen, try to stay within your age group. If you’re twelve, keep it in yer pants f’Chrissakes!
Ok, I have been thinking this over and I admit that there are flaws in my thinking. First off, when I think of friends who regret starting sexual relations early all have one thing in common. They were sleeping with people their own age. Neither partner had the necessary maturity to keep the relationship going, especially if there was a pregnancy. I can see how an adult would bring a maturity to the relationship and have a different outcome.
However, it still seems like a 16 year old would be better equipped to handle sex than a 12 year old would.

I suppose you would have to be rich to own a place there, but the majority of folks rent houses for the summer and go with big groups of friends. Hoo, I can’t even begin to count the number of lapsed Catholics, Christians, Jews and whatnot there are in the gay community. A disproportionate number of gay men and lesbians are “disillusioned with organized religion,” and I’ll betcha most of them are so because of their sexual orientation. I’ve never actually seen any survey figures, however - this is from personal observation.
